i will be mailing the AOS and EAD together for my husband. He is here on a K3 and i hear ppl saying that I can mail these forms together. So my question is, WHICH ADDRESS? We live in Michigan and I couldnt seem to find a place on the form where to mail these forms together only the mailing address to separate service center if filing separately or would it be best I just mail them separately to the address where it says on the form??

Thank you.

Did you follow your other thread and the information about the EAD validity length. There can be an advantage to filing separately.

For K3 holders, if you send the EAD and AOS in separate packages, then you'll get a 2 year EAD (supposed to anyway). If you send them together in the same package, you'll only get a 1 year EAD.

Send them separately.

I wish you had looked for it--I think this convo is going on in four threads now!

Yodrak's correction was more to the point and accurate than my quote:

meauxna,

Points of clarification:

- A K3 should apply for EA prior to applying for AOS in order to get a 2-year EAD. Applying separately from but after applying for AOS is the same as applying with AOS - 1-year EAD.

- The 2 years starts from date of entry (as you mention parenthetically) as indicated on I-94, it is not tied to the visa.

Yodrak

K-3s are eligible for a two-year validity EAD *if* they apply for EAD before the AOS application.

This can be beneficial insurance if you want to delay filing AOS *or* if something causes your AOS to be delayed (namechecks etc)

Reba,

Not necessarily. It's not the 'separateness' of mailing that makes a difference, it's the basis for requesting EA that makes the difference.

A K3, like a K1, who applies for EA prior to applying for adjustment gets an EAD that is good for the duration of the I-94. Useless for the K1, great for the K3.
