I-751 filers traveling when both conditional GC and extension letter are expired and no I-551 passport stamp

Airlines can be fined for allowing people to travel to the US who aren't in possession of valid entry documents. That's why they ask, ask, and then ask again before you're allowed to set foot in the plane. 

 

There isn't really an excuse for not obtaining an I-551 stamp. At the most it should take you only a handful of weeks, and that's assuming you have to wait for more Infopass slots to open up. 

This is the second week I am following up and I feel better about finding appointments although I still think it may take up to a month so the question here is what to do if you are still waiting for the perfect slot and happen to find your self in situation where you need an "emergency stamp". I think the consensus so far is to try a walk in appointment.

Do a walk-in, but do take something that shows the reason - like an email telling you that a loved one has died, or a death announcement.  If you have already been able to MAKE an airline reservation, take a copy of the reservation, too.  While we tend to think of USCIS, NVC and the ASCs as the enemy, there is usually someone who can help, if you come with a good reason, a good attitude, and, at least, a smile.

Your comment makes me think that in days like these it would definitely be easier from the Canadian side than from the Mexican side. It also brought to my mind that my naïveté once revealed that the Canadian border officers can be pretty mean too...

Agreed. Still the media tried to portray the Royal Canadian Mounted Police as the "good guys" helping people to cross the Canadian border on foot, allegedly running from the "bad guys".

As a follow up to the message above, I was able to schedule an infopass appointment this morning so let us see how that goes.

Another follow up. I wanted to share my experience with the extension letter from the past few days. To recap my background, my CR6 GC expired in October/2016 but I got an extension letter dated July/2016, for one year and the CSC has my I-751 case. I went to an impromptu day trip to Canada last week and when I was crossing the Canadian land border, the officer was suprised that my GC was expired and that had not received another one yet. He said that, to him, my extension letter was expired. I told him that he should count one year from the GC expiration date. He didn't look entirely convinced but let me in anyways. On my way back to the US, the CBP officer flat out told me that my extension letter had expired last month and referred me for secondary inspection under code  "IO04". I waited almost an hour in the line. The officer that saw me didn't even know what was going on and initially asked me I was bringing currency over the limits into the US(???). After me explaining the expiration issue, he spoke with the officer that initially saw me at the border, spent a few minutes looking at the computer and released me. It was a total of almost 1:30 hours for primary and secondary inspections, including waiting in line, but maybe just 10 minutes or less with the officer. Today I went to my infopass appointment to get my I-551 and asked the officer about the expiration issue. He was kind of vague and just told me that the status doesn't expire, it was just an issue with the documents. My recommendation to all is to err on the side of caution and only travel abroad if your letter was issued in within the extension period it states. Travel to Canada is OK but be prepared for secondary inspection.

An issue with the officer more like....

 

It is put very clearly HERE in this officially issued carrier information guide, on p38, the receipt date (in your case July 2016) has no effect on the validity of the card, and that it extends it for a specified period of time- generally one year- which is exactly what your extension letter states.

 

What a total waste of time and resources.

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

You really shouldn't have to - this is very much a 'you had one job' scenario and quite honestly they should know this stuff-  but yes I agree it is sensible.
