Minor Child / Permission to leave Country

Hope everyone is doing well.

 

 

My girlfriend has a 7-year-old son by an ex-boyfriend. they were never married.  Sadly, the dad was killed.  From my understanding, there is no death certificate because nobody claimed the body.  Also, I understand that the father has to allow permission for his son to leave the country or even get a passport.  So, my question is how can he sign or allow permission, if he has died and there is no death certificate?  My girlfriend is from Nicaragua.  I bet other Central American countries may have the same rules or very similar.

Is the guy listed on the child's birth certificate as the father? If so, there's going to need to be some kind of documentation either stating his death 

Family is priority in Nica culture. You don't need to answer these questions but these are the kind that came to my mind...So there was no funeral for him? He had zero family or friends to id him? Under what circumstances did he die? How does anyone even know he even died if there isn't any kind of record and no one claimed him (without a document to show the consulate, this is the same question they will need answered)? Unclaimed bodies will have an experiente from the morgue with info like cause of death, description etc. 

 

I don't have any experience in a situation like this but I've known Nicaragua for over half my life (not that i'm very old or anything). There is a saying there that says "no estaba muerta, andaba parranda". Something isn't adding up to what your girlfriend is telling you. I asked my Nica husband about your situation and had the same questions. Sounds more like he was one of those machistas who just up and left her and his kid 'cause he didn't want the responsibility and left a broken family in his wake. Awful! 

 

I don't mean any disrespect to you or your girlfriend with whatever she went through, especially as a single mother. What she told you isn't making sense, at least with the information that you were given and have given.

 

Have her get a document that states that she has full custody of her son, I think that will help. Make sure it gets notarized by a Nica lawyer.

Sorry I can't be of more help to you but perhaps that custody document will get you on the right trail.
