How i will know if my priority date is current or not?

 

 And btw im am still eligible for cspa? Even though my father and my brother already submitted their ds260 is there any ways that i can do right now? My auntie called (was in the us right now) already called nvc they said that im not approved but we can email them for us to dispute it. How long is the process? Btw im derivative beneficiary of my father who is petitioned by his mother. And we already received the WL letter and already finish submitting the ds260 for them for me not yet because my name does not appear in the website. Is there any chance that my would appear?  

 

My birthday is September 12 1995

and im 21 and 10 months old

You would need to give your I-130 approval date to get an answer.

The notice date was 11/05/2007 

is it the same with the approval date? Which is the notice date thank you for your answer. Im really worried because my aunti told me that the notice date was 11/05/2007 date of filing was 05/29/2007 and priority date was 07/05/2007.

No, sorry, you have aged-out.

 

You can only deduct the processing time of the I-130 from your biological age to arrive at your "CSPA age". Even if your priority date was current this month (and it isn't), you would still only be able to deduct four months from your biological age, and you'd still be over 21. In actuality, your priority date won't be current probably for another ~6-8 months.

 

This assumes your I-130 was approved in November 2007 as you stated. You may wish to double-check that, as it's kinda important.

If the I-130 was approved in November or even December or January or February of the following year, that's still not long enough. Basically you needed it to be pending for as long as possible so as to gain more "pending time" that could then have been deducted under CSPA.

 

You won't be able to immigrate under this petition.

One of your parents can immigrate and then petition you separately under a new I-130 F2B petition, but the wait time will begin over and you wouldn't be able to immigrate for around 11 years.

When we receive the priority date letter the date was nov 2007 is that the date that petition approved? And it saying your priority date was july 05 2007, the date we receive it was nov 2007

Your aunt would have received an I-797C NoA receipt first, and then a few months or so later an I-797 approval notice printed on security paper, and it would say "approval notice" on it.

 

Either way, it's very unlikely the I-130 was pending for long enough to help you. At this point you'd need it to have been pending for a couple of years to even have a chance, and that's extremely unlikely.
