He could talk to HR rather than his boss. Has his boss talked to HR? Is this a company policy? It is just weird.

I'm not exactly sure how you can change companies, but with an H1B it seems it is not very complicated. Also, a GC process can take 5 years so he needs to make decisions now.

A lot of companies will not openingly admit to their employees that they are willing to sponsor GC applications nor will they even co-sign the I-140 when the applicant is self paying and self submitting the application. Reason being is they don't want to be seen by the Government as bringing in people on non immigrant visas then putting them through AOS (green card factory) Such companies risk having their blanket I-129 petitions revoked. I work for a multi-international company who offered to sponsor my GC back in the day but at that time, a GC wasn't on our agenda (I'm married to a USC) and we moved to the U.K. instead. 

 

At least one of my friends are sponsoring themselves through EB-1 AOS

Aug 13th: Text notification for EAD. Card being produced

Aug 15th: Text notification for EAD & AP. Case approved

Aug 18th: Text notification for EAD. Card has been mailed

Aug 20th: EAD/AP Combo card delivered

2017

April 16th: Applied for EAD/AP renewal

April 25th: EAD/AP case received

May 16th: Text notification received for AOS case status update: interview is scheduled

June 06th: Redo medical

June 20th: Interview date. Evening email: "We ordered your new card"

June 21st: Email received "Case was approved"

June 23rd: Email received "Card was mailed to me"

June 27th: 10 year Green Card delivered 

 

March 22nd 2020: N-400 window opens

First, they have to do the labor certification, which takes 6 months. Then, there is something else that can take a while or you can pay for premium processing. Then, you get a priority date based on your education level and your country. If you have a PhD then your date would be current and the whole process from start to finish takes roughly 2 years. But if you don't, then your priority date is a bit further away.

My husband did GC through job and it took 4-5 years. And the company had really good lawyers on top of everything.

Many Germans use E2 Visas. It is not that hard. This company is specialized in E2 visas and has a 90%+ success rate:

They are a one stop shop. Means, the have businesses lined up, make the business plan, and make the application papers.

As long as he has money, or is able to loan money from bank or friends, he can go this route. Of course, he must be willing

to run his own business. The fees involved will be in total about $10.000 with business plan etc. and he would need around

$100.000 from loans, own resources or friends, depending on what business he would like to run.

Just to clarify - He would remain legally while the GC application is pending.

Because what's in it for the company? Right now he is tied to the company. They are pretty much guaranteed to keep him. If they sponsored his green card, they run the risk that he leaves and takes his expertise and knowledge to a competitor.

Sure, but he has 2 years left, basically. Why loose a valuable employee with a lot of years of experience?

 

A lot of companies do what you mention, but mostly the onces that discard employees and get new ones, like TATA.

Hi! I self petitioned GC through EB2-NIW. If your friend has an advanced degree in a field of National Interest he can go for that without sponsor or marriage.
