Timeline

Hi everyone! I am posting here in behalf of a friend of mine whose been in the US for 7 years now. He's from Germany and he is on a working visa and he wanted to stay here and obtain a Greencard, but his employer won't sponsor him. Is there any way he can apply for Greencard aside from marrying an American Citizen? Any answers would be greatly appreciated! Thank you! -Vanessa

How much money does he have? Would he qualify for an investment-based green card? 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

It depends on what he does and how much education he has. But the easier path would be to change to a job that would sponsor him. 

 

He's an Engineer and he makes a good money. Would u mind explaining what are those "other paths" means? Thank you!

You can invest 1/2 a million dollars, usually in a building that is being built. The process takes 2 years and it could take longer to find an investment through which he would qualify for the green card (there are specifics that have to be met). Hopefully, you get all your money back but no return from your investment because the people organizing this type of investment know you are doing it for the GC. Like Trump's son in law does this to build this buildings.

I think he should be able to get another job for a company that sponsors green cards. Many do, particularly the big ones. Has he talked to HR? Basically, if they don't sponsor him there is a limit with the number of years he can work for them. I'm surprised he is making so much money (so a valuable employee), with a lot of experience, and they are not sponsoring him. The companies I've seen that don't sponsor are the ones that bring people from abroad and they pay them peanuts, like TATA, and then replace them with other people they bring.

That's what he is trying to do. In fact his company extended his Visa for another 2 years. He had a sit down meeting with his boss or something and one of the conditions he discussed about is if they could sponsor him to get a Greencard but they said No or They can't. He wanted to stay here coz he is used to living here in the states now and he doesn't see himself living back in Germany. He is a man with goals and ambitions not just for him but also for his family and it's sad that he couldn't stay here as a permanent resident although he has been here for years,working his ### off, paid taxes and etc while there are illegal immigrants out there living the American dream so easy. Sigh
