Hello everyone, I am a  Conditional green card holder married to a USC. I sent in my ROC Dec 2016 and still haven't heard anything yet but that's not the reason for reaching out. I am thinking of having my 10 year old son move to the US to join us and My question(s) are as thus. Can I petition for my son alone when my ROC is approved and I receive my 10 year card or Can myself and my USC wife jointly do it? I understand that my wife can file for my son as a step mom. What is the best option and means to go about this? How long does the process normally take? Please, I need some sound inputs. Thanks everyone.

Normal process: 5 to 6 months for approval. 3 to 4 months for visa processing. All in all 7 to 10 months sometimes less sometimes more.

Awesome!!! Can I file the paper work while my ROC is still pending or should I wait after I have the 10 year card? Or Can myself and my USC wife jointly do the filing? What kinda form is required for this type of case? Sorry if I'm putting too many questions but we are all here for same goal and to help each other. Thanks

If you are a permanent residence card holder you can file it. No need to wait for the 10 year.  Or you USC spouse can file too as a stepson, either of you two.  Form is I-130. Its easy as your son is minor. You can see the instructions and requirements needed in the form.

It's better for the USC to file for it. If the green card holder petitions, you're looking at about a 2 year wait from filing to visa (F2A preference). If the USC files for it, you're looking at about a year from filing to visa (IR-2).
