1stly you have to count are you eligible under CSPA or not, in that case you need to know when your petition was approved. NVC doesn't do calculation, apparently they saw, that you are already 21 and didn't include you. Sometimes people are getting included after they call NVC and explane their situation, that they are eligible under CSPA, but sometimes they are being told to come to interview and consul will make decision.

What im really worried most is the "seeking to acquire" within one year. And that time we do not know when it comes. So right now im asking my auntie for our approval date. So for now let's assume it was approved 2 years or 3 years ago. That time i was under age. How i can do the or submit that ds260 that time? If we dont have an access that time which is the case number and invoice number. Im really confused give some light.. Why they told my auntie that they calculate it and im not approved but send them an email for dispute so that they will calculate it again.

If it would be 2 years, then you would be eligible till 23.

I'm confused with your status.  

 

Petitioner: Mom or Aunt?

Applicant: you or mom?  Are you a derivative beneficiary?

Priority date: July 5, 2007?

Visa category: F?

 

I will share with you what my mom did for my sister.  My aunt petitioned my mom under F4 category.  When the visa bulletin looks like it will become current in the next couple of months, my mom wrote to NVC that my youngest sister will soon turn 21 years old.  NVC noted it and when the priority date became current, she was included in the petition even though she aged out prior to the interview date but was still under 21 when PD became current.

 

so.. what really is your situation?  If your mom petitioned you as lpr and you were underage, you will be under f2a category and that is quite fast.  However, if it's your aunt who petitioned your mom and you are a derivative, the August bulletin is still April 1994.  I doubt you will be included in the petition any more and cspa will not help you.
