I just got RFE for my AOS plsssss help

Timeline

I got my RFE today by mail we are confused pls.. can someone enlighten us??? One RFE says an income amount is sufficient and asking to give income evidence, about employment etc  on the other hand the other RFE Says the income did not meet the poverty guideline.. we checked for poverty guide line. my husband makes above enough to sponsor me.. we really need your oppinion.. thanks a lot.

If you only sent a tax return then that's the issue. They require more evidence than that. Read the RFE and provide them with all the documentation it lists.

A tax return without the w2 and any forms or schedules that were filed with it is an incomplete return. The statement about not meeting requirement is standard when enough evidence of the claimed income isn't found.

Let the USC sign up on the IRS website and print out last year's tax return transcripts. No need for W2's or 1099's since everything is on the transcript.  

 

I did this too when I received a RFIE for insufficient  tax return and I got approved. 

01/13/2016: I-129F filed  07/15/2016: K-1 visa in hand
10/13/2016: Filed AOS + EAD/AP.   07/07/2017: Permanent resident (Conditional)
04/16/2019: Filed ROC  11/17/2020: Approved. (10 yr GC)

10/22/2020: Biometrics Reuse Notice.  12/22/2020: Online Status Changed to Interview Was Scheduled.

Thanks dear they have also asked bank statement... just wondering does it really matter if we don't have a lot in our account??. How much do they expect us to have in our bank deposit🤔🤔

If you are not using assets to meet the requirement you do not need to send a bank statement nor should you fill out that part of the form (this is stated on the form as well). If you have filled out the information they assume you are using assets and if you are putting information in the form you also have to supply evidence of that information.

It stated in the form as optional er did not gill out but on the RFE we are asked to present for the last 12 months🙂🙂

Usually they just give a list of examples on the rfe for that part ( Iassume it is after the do not meet requirement part?), if so it's just suggested, but if you are not using assets no need for any bank statement.

Yes it's for the do not meet the requirement part... we did not fill out since it was optional.. we will fill out the form again and send all the evidence.  Like pay stab, letter from employment tax return w2,..

Hello friends, how long does it take for my status to change after they receive I-485 RFE? And does RFE affect my EAD( will it delay)? Today is 72days since they received🤔

Just to be 100% certain...was it an RFE or RFIE? Typically issues with the I-864 are an RFIE.

 

If it's an RFE, it won't impact EAD processing. At 75 days, you can put in a service request (albeit they are taking 90-120 days currently, so I'm not sure what a service request would do).

If it's an RFIE, it resets the clock from when you can submit a service request. That said, I haven't seen a significant difference in actual processing time between those with an RFIE and those without it (assuming it is responded to promptly).

thank you.. It says request for initial evidence many people says RFE.. what's the difference? 🤔🤔  I posted the same question on fb group one person replied "RfE restarts your days from 0. So count 90 days from the day they receive your reply for your RFE. Forget about the 72 days. You will get reply within 90 days. I was approved for EAD almost 60 days after they got the reply for TBD RfE. The waiting game starts now"  i didn't wanna believe this😔😔 so i decided to ask as many people as I could...
