NVC Stage potential issue

Hello,

 

I'm looking for some help.  My wife is currently in school right now in Germany.  She is studying on a resident permit, but is a citizen of Ukraine.  I filled out my I-130 perfectly, I'm guessing because her current address is located in Germany, they have set my interview site for Frankfurt, Germany.  HOWEVER, her resident permit will expire at the end of October. Listed on the NVC page is:

 

Foreign States of Chargeability: Ukraine

Interview Location: Frankfurt

 

I am a bit shocked right now and not sure what to do.  My NVC stage is all filed through CEAC, so I know this is quicker process.  I just don't want to have an interview later than October and she can't go back and enter the country.

Maybe this answers my question?  I just am apprehensive of the fact that she is a citizen of Ukraine interviewing in a different country, and if this does have any effects on the interview process.

Hi all,

 

We were selected for CEAC processing (I found this strange because Kiev is not listed for CEAC), but now that my case number has been assigned, it turns out our selected interview location is Frankfurt, Germany NOT Kiev, Ukraine (which now makes sense).

 

My wife has a resident permit for Germany as a student which expires October 31st and is currently still in school, although she is a citizen of Ukraine. An NVC operator said this is fine that she interviews in Germany as long as she is a legal resident, however I am a touch apprehensive, not only because he didn't sound sure of himself, but I too am not convinced. 

 

Does anyone have any advice or experience interviewing in a country other than their home?

Yes, you can interview outside your native-born country. You can interview at any embassy where you have legal residence.

 

My fiancee was going to interview in Riyadh, where she worked. However, due to the timing (NOA2 was taking months less at the time we initially filed), we transferred the case to her home country (Philippines) since her work contract was expiring. Anyway, if your wife will be a resident until she receives the visa, then it won't be any issue.

 

Note that she needs to retain legal residence until she gets the visa, and there is no fixed timeline for that to happen. If you think she will no longer have legal status in Germany by the time the visa is issued, then it may be better to transfer the case to Ukraine. Unfortunately, I'm not familiar with the CR-1/IR-1 timelines for Frankfurt to have any real input on how long to expect, sorry.
