OOOH now that's sweet!! I don't think they gave me 52 weeks.. i think it was closer to 32 or something.. I dunno..

Yep.. we are going to buy some furnature with some of it.. currently we have a 3 bedroom apt. with a futon and a folding card table for furnature.. sad.. but true :)

No no no...

Your claim is OPEN for 52 weeks, but you are only eligible to receive money for 36 of those 52 weeks. So for K3 holders like myself, I need to get authorisation before those 52 weeks are up.

Well mine was listed in My Claim tab on my online case status thingermajiggy.. that was until this last bit of paperwork was sent in.. then they took all the info off..

So if you have your 4 digit password from your cards Misa you should be able to go online and see how many weeks you are approved for and how much $$ / week you can get.

Yup, I got my 4 digit password but my case is still in review since I have no EAD... poop.

Yeah, she knew EXACTLY that K1s had authorisation. Right off the bat. She said the memo (not sure if it was a US memo or what) was from August 2006.

92 days since filing and counting.. right now I will be getting ALL my money at once.. not that I'm going to complain if they do approve it.. it just seems to have taken so LONG :) geepers

I filed my EI application online after I moved to the US....... I filed it on March 24th and mailed away a copy of the SSA

Policy with one of my ROE's I had to send them. I highlighted all the areas on the policy in bright yellow where it mentions that K1's have work authorization. I thought I would get a jump on them instead of waiting to see if they tell me I wasn't eligible as they have done with others. I also sent them a copy of my marriage certificate and asked them to change my file to my married name. Finally on May 7th.... so it was 6 weeks and 2 days.... my EI online thingy said two checks have been processed on that date. I still haven't received them in the mail though..... they had my US address really messed up so I hope they aren't lost in the mail. The first set of cards I received took just over two weeks so I'm hoping these checks will show up soon. I still won't be paid up to date even when I get these two checks but it's a start.

I guess it's just liike the immigration process...... some couples go through it with no problems and others get RFE's for things they already supplied. Go figure.

Timeline

Just a note about US addresses vs. Canadian.

In Canada when you abbreviate an address with an apartment number (e.g., 123 Street Avenue, Apt. 1), this is the way it is done: 1-123 Street Avenue.

But in the U.S., it's opposite! It would be 123-1 Street Avenue.

And Canadian government agencies have a tendancy to abbreviate addresses according to Canada Post's system which is <apartment number> - <street address>.

Might be worth it to call and ask them to use your address as the long form: 123 Street Avenue, Apt. 1

Excellent Susan!! Sounds good! I am glad they gave you the $$ :) And when I updated my US address they did put apt# first - Street number - Street Name. Our Postmaster here in the US always forwarded it through, but it always came late and it was always marked up (to say how it should read Street number - street name - apt #.. If you call the 1800 # they can and will change it for you to be "american speak". :)

And I think that's the key.. tell EI right up front when you send the ROE with the SSN pages that K-1 is Work Authorized. I think that's the only "Safe" way to make sure you get it. I was assuming I wouldn't be approved with out it.. but my first lady from EI who called TOLD me I was approved.. so I assumed (wrong I know) that she knew all about K-1 and I would get $$ easy.. which turned out to be not true :)

Here I am. Please let me in in the EI boat as I am just as confused as everybody else. Its my first time with EI too.

Im a K-1. I applied online for EI online on May 3rd. I received a letter in the mail last saturday with that form asking about my status in the states. Here I dont know if the answer is yes about if I have a working Visa, because K-1 is not a visa for work, not like the TN or the other ones.

I am currently putting together these below to send it to them and I will be sending my EAD and AOS forms next week so as soon as I receive the NOA I will send them as well.

Anyway for anyone who is planning on applying here's what i suggest (for K-1'ers)

- Copy of ROE

- Copy of I-94

- Copy of Marraige Licence

- Copy of NOA for EAD & AOS

- Copy of SSA "Work Authorization" statements listed With Applicable sections CLEARLY marked.

Hi everyone, I decided to bump this and see if anyone out there knows the truth! I've read through the Canuck EI Thread and I'm still somewhat confused.......

I'm a K1 and entered the US 2 weeks ago. We had a small ceremony last week and I applied for AOS/EAD/AP 2 days ago. I started my EI claim and mailed them the following:

1) ROE

2) Copy of I-94

3) Copy of K1 visa

4) Copy of marriage certificate

5) Copy of section of Social Security website that states K1s are authorized to work w/ out specific authorization from INS

I'll mail them my NOA for the EAD as soon as I have it. My question isn't a new one around here: are K1s really entitled to benefits before they get their EAD? Are there any K1s out there receiving benefits right now? They mailed me a letter and asked if I had a working visa from the US which allows me to work. I said "yes." Is this right? They mailed me cards as well. Do I fill them out and send them?

I also received 2 cards for the periods covering April-29/May-12 and May-13/May-19 which is covering a total of 3 weeks. I dunno what to write in those, because YES K-1 are eligible for work but NO i didnt get my stamp at the POE so I cant work. And I dunno if I am supposed to provide potential employers addresses or what because I didnt apply for anything since I cant work because I dont have the stamp.

Please clarify me. Are we eligible for work or not!!!!!!! :girlwerewolf2xn: I DONT GET IT. :huh:

I feel stupid trying everything and include every proof to show them I am eligible for work and then write no on these cards cause i aint got my friggin' stamp. I am still in the 90 days of my K-1 visa until mid-July BTW. I just dont want to receive any money and have to refund them after. I dont care really if I dont get it and I would rather start collecting EI when I have my EAD in hand and have no confusion whatsoever. Its just yeah of course money would be welcome and If I can have it during the 90 days of the K-1 I wouldnt say no.

By the way, I have a hard time adjusting myself, well I did in the last 3 weeks. We just moved in a new appartment together and it was his first moving in 8 years, from a house to an appartment. I had his garage in my living room and I was alone at home putting everything in place and cleaning everything for about 3 weeks and I did freak out before the wedding because we didnt have a chance to spend tiem together. I cried a lot the night before we were leaving to Michigan for the wedding and we had a dispute on our wedding morning :( We both have really strong personnalities. We had a talk after and in the afternoon what the pastor said to us almost sound like he knew we had a dispute and made us think about it a lot. He said something like " In life, when hard times are around, you must overcome your anger and look into your hearts and see the true love you feel for each other to be able to support and care for each other". Thats the slap in the face we needed to see that it was all about stress. Everything is perfect now that everything is done ( moving, wedding) and I can sit down and write to my friends and family and take care of my stuff :) Its hard to be alone at home, no car, no job, but I dont regret any minute to be here. We are all here on VJ to support each other girls!!! (F)

:lol: I did the same thing when I first saw it years and years ago. I had forgotten all about it when, suddenly, it popped into my head the other day while thinking about this whole darned visa process. It seemed appropriate in some weird distorted way.

Everything is perfect now that everything is done ( moving, wedding) and I can sit down and write to my friends and family and take care of my stuff :) Its hard to be alone at home, no car, no job, but I dont regret any minute to be here. We are all here on VJ to support each other girls!!! (F)

Weird about the 3 weeks.. My cards always were for 2 weeks exactly.. huh.. I had a half week where I was uneligible on my first card(cause I moved to the US and put a couple of days down for the move & readjustment). I just noted that on the front and went from there..

You will automatically loose the first 2 weeks as a waiting period..

You can put YES down as ready willing able to work.. cause you are.. You are Technically Work Authorized (even without the stamp).. Keep going on that track until your I-94 runs out.. then you are not K-1 anymore and you'll have to wait like K-3'ers for the EAD or greencard. I'm out of elligibility as of May 5th so I'll mark that on all cards after that (got EAD approved yesterday so I'm back on EI as of yesterday).

YOu don't have to provide employers contacts unless they ask for them. Just keep note of who you contact (3 per week), and then you have it if they call. My guess is they don't check too often, but they have every right to.

Looks like you are well on your way.. THey will probably give you a call just to chat with you about your paperwork in about a month (that's what they did with me).. in the meantime keep saying you are ready willing and able to work ;) Here's to smooth sailing!

While on EI, always good to screen ur calls, lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

Wow......I guess its that easy. One more question thought. Is that normal that they sent me the cards before i sent them any information ? I mean the ROE and all are in the enveloppe ready to get send but they dont have it as of yet.

Wow......I guess its that easy. One more question thought. Is that normal that they sent me the cards before i sent them any information ? I mean the ROE and all are in the enveloppe ready to get send but they dont have it as of yet.

I filed my ROE right away when I did the online application so I'm not sure if I got them because of the online application or the ROE being sent in.. As the "nasty" lady at EI said (the only one I ran into).. just cause you get cards doesn't mean you are approved.. everyone gets cards who applies..

:) So yep.. I think because you applied online, you got the cards! Best of luck!! May your claim be looked at by "Mauren" (the woman who looked at Misa's Stuff :))

Yep, getting the cards means nothing, just that there are a few less trees!! I got my cards, was all happy, then WHAM, got a letter and a call stating I had been denied!! Fought it and won!!

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
