Hello Everyone,

 

I recently run into a small problem. I'm trying to bring my parents to USA. I'm US citizen for the past 7 years. However, I have no income, I'm stay-at-home mom. I was working only once for 6 months and all these years my husband was filling out the taxes by himself. But he was checking the "married filling jointly" box.

      So when I filed the I-130 and got approved, I have to file I-864 as a Sponsor, and my husband will file I-864a in order for me to use his income. But in the I-864 (which I'm filing since they are my parents) form I have to put the Tax Returns and amount.

Question: Since we were filling jointly, do I need to put mark on 18a as YES, that I filed the Tax returns and if Yes, do I write our total income in each year in part 19a-c, lets say $40,000( my husband's[40,000] + mine[ 0 ] ) or do I have to put only mine, which [ 0 ] for all 3 years? In his form I-864a he will provide information of his income and tax returns.

If you submitted jointly then you must enter the amount that appears on the tax return do not separate income..you only put the income that u made by yourself in the box that asks you for annual income

Franciscoruizt thank you very much! And also does anybody know how to fill out part 3 and 5? I filed 2 separate I-130 form for my mother and my step-father. They will be immigrating at the same time.

 

In part 3: Do I need to include my step-father into my mom's I-864 form and check both 1 and 2 boxes? And vice-versa for my step-father's I-864, do I include my mom?

Also how do I calculate in Part 5 if I include them both? Or if I don't include? Which one is right?

 

1 option: 

Me,my husband, my daughter, my son (4) + mom(1) = household size: 05 ( shows on I-864 for my mom if I don't include my SF in Part3)

Me,my husband, my daughter, my son(4) + st-father(1)=household size: 05 (show son I-864 for my SF, if I don't include my mom in Part3)

 

2 option:

Me,my husband, my daughter, my son (4) + mom, my step-father(2) = household size: 06

Me,my husband, my daughter, my son (4) + my step-father, my mom (2)= household size: 06
