Window of time between i-130 and i-864

Hi all,

 

Apologies if this has been asked before. My fiance and I are planning to get married in Moscow and then petition the i-130 for him. After (if) the i-130 is approved, is there a window of time before the i-864 AOS forms are due? 30 days, 6 months, 1 year? I would like to return to the US to find a job before I file the i-864 (I am currently in Russia). 

 

If the i-864 is not immediately due after the i-130 approval, has anyone ever lived abroad, and then returned to the US to seek employment before filing AOS? Unfortunately, I do not make enough in Moscow to qualify for i-864, nor is a sponsor a viable option.

The I-864 will be requested after the I-130 is approved. That may take anywhere from 3-4 months to a year or longer depending on what service center your case is sent to (most are 6+ months). Nobody can know for sure how long it will take, but here's data based on other VJ members:

As for when the I-864 is requested after the I-130 is approved, it's generally a matter of couple/few weeks before NVC will request it.

 

Even if you made enough money in Moscow, it likely wouldn't qualify for the I-864. The income has to continue from the same source after returning to the US. So returning to the US beforehand is probably for the best.
