BT said it would be almost a no... that every attempt would need to be made to fill it state side and then it would cost them a LOT So would probably be a no but can't hurt trying... So my option is to go through my dad. The ex is moving over on her own accord with my kids. It a not desperation out of getting to Florida it's I would do anything not to be with out my kids. If they moved tp l Germany I'd be going there instead. 

 

Currently we live round the corner from each other and I literally walk round let myself in make a cuppa wait for kids to come home from school cook their dinners. So we do have a close relationship which newer relationships have suffered from but the fact is I love my kids.

 

I do apologise if I've broken a rule on here sincerely. I just wanted to ask as my ex was the one who suggested this and should I be able to come through her application so I said I'd find out.

That's where I am.

As far as I know, and anyone correct me if I'm wrong - she can only get a work visa through an employer sponsoring her and the requirements for skilled professional are pretty high. With a nursing degree she would only ever possibly be considered in the EB-3 category (the other categories require exceptional skill and/or advanced degrees, investors and such.

The stipulations she'd have to over come for the EB-3 are:

"You must be performing work for which qualified workers are not available in the United States"

"Labor certification and a permanent, full-time job offer required."

It is honestly VERY unlikely for her.

I have a friend whose wife got a H1b, unusual and her job did require a degree, most nursing jobs do not.

 

Remember that the Courts are most unlikely to let her take the children without your approval.

I would never stop her taking them, i would want them to have a better life... i would just prefer to be a part of it.

 

I think the word "nursing" across the world is very different. In the UK we have HCA's Heal care assistants... which in other countries label them as nurses. She is a fully qualified matron "registered nurse". (if you all know this im not teaching you to suck eggs) Im under the understanding that the USA will sponsor her as a RN. She is looking at taking her NCLEX exams which (from my understanding) are the equivelency exams for our degrees here in the UK to transfers her quals to the US.

 

Ive been googling a load and there are jobs for "Nurses" and jobs for "Registered Nurses"

Plenty of nursing boards that cover this and anyway it is her issue.

 

Probably a good idea to make sure that you tie up the loose ends legally, how much access you will have, wich holidays they spend with you, who pays for the flights etc etc.

I'm not saying it is not a qualified job that she has - but not for this purpose.. she has a Baccalaureate, and not an advanced degree and she doesn't have an extraordinary skill. There are jobs sure, but you have to get the employer to sponsor her for a work visa and for the skilled professional there has to be a job offer and it must be shown that they can not hire a US person.

Just to clarify...

She needs to be licensed by the BON in whatever state that she will work. While passing the NCLEX is necessary for this, that's separate from credential validation (also required by each state's BON). Basically a 3rd party (like CGFNS) verifies her foreign-earned credentials, then she can apply at the state's BON and earn a seat to take the NCLEX.

 

And yes, for immigration purposes it would be difficult as it doesn't require an "advanced degree". Far from impossible, but still difficult.

Immigrating as a nurse can be done.

 

But you do not get to bring your ex with you.
