Hi friends, I am again here with my new immigration questions with great hope that you will help me this time aslo like before. Actally I applied for me and for my son removal conditon green card in August 2016 but I didnot recieve my green cards yet. My conditioner cards were expired on spetember 2016. I have extention letters for one year which will end on september 19, 2017 which is after a month and few days from now. So my question is what should I do now? Just wait or..there is something I can do. Also, I want to know when I will be able to apply for citezenship. On visajourney, I read that I can apply for citizenship after three years of parmanent residence but my agent said that I can apply after 3years and 6 months after becoming residence. I m married with my citizen husband for 5years and 6 months now. I will be living in usa for three years on septemmber 19, 2017. Thank u.

Hi ,, It's ok .. i received mine after 1 year and half ! .. they take a long time with that specially if your case is in Vermont ? .. what you have to do if your extension letter expires try to take an info pass from the nearest USCIS office and they will stamp your passport for an extra year ! and for the citizenship you cant apply while your green card is pending ! good luck

It's not uncommon for ROC to take over a year at many service centers. Yes, you can apply for citizenship under the 3 year rule while waiting for ROC to complete so long as you meet the 3 year rule requirements (other than having completed ROC). You can apply 90 days prior to the 3 year anniversary of your original green card ("Resident Since" on the green card). How long you've been married or actually living in the US doesn't matter...it's based on how long you've been a permanent resident.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

I believe they are on May 2016 filers. It's taking 15 to 18 months now. Most re ready to file citizenship so you will be able in August to file that.

It goes on the date of the card.  Now you can go and get a I551  stamp in your passport  at a field office, if your extension letter runs out, which enables you to travel and work while you are still waiting. My field office said I could do this 2 weeks before my letter expires, but I think it differs with each field office. 

 

I think, not 100 percent sure as I have not got to that stage or looked in it, but I think you may be able to do a service request after a year of waiting.  I am sure someone on this forum will clarify this for you!

Youre welcome, however I thought about a service request after I commented and I think that a year isnt quite right, I think if I remember from AOS, you have to wait until California is stating on processing times that it is processing your date.    At the moment according to processing times it's either June or July.  You can't make a service request I don't think, until it shows its processing September cases and then it has to be the day you filed or a later date.  Just looked they are processing June https://egov.uscis.gov/cris/processingTimesDisplay.do;jsessionid=abcJO7HL1clIb6rZLob2v  as from the end of April.  These processing times are updated each month, around the middle of the month.  Once they say they are processing your date then you can make that service request.

As previously mentioned, you can get a passport stamp if you make an InfoPass appointment at your local USCIS office that will extend your GC for another year. 

 

My question, though, is: why should you need to remove conditions at all? If you've been married to your husband for 5.5 years, then you must've already been married more than 2 years when you became a permanent resident. You should have gotten a 10 year green card from the beginning, shouldn't you?

 

And yes, fire your "agent" - especially if he/she had anything to do with you getting the wrong GC when you came to the US and not correcting it! 

 

The only thing that would keep you from filing for naturalization right on time is if you spent more than 6 months out of the US on one trip or if you've spent more than 18 months outside of the US in total over the 3 years. 

 

If you have been married to the person who petitioned you the whole 3 years, and you are within 90 days of the anniversary of your green card, and you've been living in the state where you're going to apply for at least 3 months, and you haven't been absent from the US for more than 6 months on one trip or 18 months altogether since becoming a permanent resident, you can apply for citizenship 90 days before the 1 year anniversary of your residency

Not true... as long as you're still married to the USC that got you your green card, the state of your I-751 petition has no bearing on whether you can apply for citizenship. 3 yrs less 90 days after you became a permanent resident, you can apply for citizenship.

Hi. Thank u for your response. Actually i married to my husband 4.5 years now not 5.5 years. It is by mistake. I married t o my husbamd in January 2013 and I entered in USA in september 14 which is before completing the two years marriage anniversery. So I got conditonal green cards. Thank u freind.

Hi. Can I file for citizenship in August? My extension letter will expire in September 19, 2017. Can I apply without stamp in my passport or without ten years green card? I think I can only make an infopass appointment two weeks ago before the expiry date of extension letter.

Ok thank u. Stamp on passport is not enought to apply for citizenship? Some says that it is enough to appy for citizenship.
