ROC - Affidavit

Hi everyone,

I am almost done with all the evidence and form for my ROC. The only question I have is about the Affidavits. I know they can be from friends or family... but do these people have to be US Citizens? My sister is a permanent resident living in a different state (she married a US citizen!) and she knows our relationship very well and so does her husband. They attended our wedding and spent many holidays with us (prior and after we got married). We are a military family and we move a lot. We do not have a lot of friends/family that we could ask to do this affidavit (Many are deployed or live out of the country due to orders).

 

Also - I have read a few posts here and many have given samples of their Affidavit, which included a notary portion. Is this necessary? It doesn't say anything on the form instructions that we need to have that notarized.

 

We have a lot of evidence that our relationship is true and not fraud. We have registration of our car under both of our names, life insurance where I am the beneficiary, joint tax, leases, Power of Attorney signed in front of a notary, joint savings and checking account, many pictures of us going on vacation. There is no way this could be fraud LOL.

Hi.  I-751 instructions does not require that the sworn affidavit should come from a US Citizen, so your sister can write the affidavit.  It has to be notarized for it to be considered a "sworn affidavit".  Your sister can get the affidavit notarized at her bank, and it should be free.
