When exactly can we apply for husband's citizenship?

Hi we're currently waiting on the ROC on my husband's green card. We filed on Sept 21, 2016. I'm trying to find out when he can apply for naturalization. All the guides I've seen says you can apply if you've been married for 3 years, so is naturalization requirement based on the date of your wedding? We got married on May 10, 2014 so we've been married more than 3 years now. So does that mean we can send in an application at any time OR is it based on the date of original green card approval, which for us was Oct 29, 2014.

 

For ROC, we were able to apply two years after the original green card approval date minus 3 months (so 21 months after approval). I had always assumed that was the case for naturalization too, but now I am confused. If anyone could clarify when we can send in our application, I'd appreciate it. Thanks!

05/14: We were married!!

06/04/14: Finally marriage license was recorded & we got a copy

06/05/14: AOS package mailed via Fed Ex overnight to USCIS Chicago Lockbox

06/06/14: (Day 00) Confirmation of delivery & receipt date recorded by USCIS

06/11/14: (Day 05) NOA 1 Hard copy of receipt received

06/13/14: (Day 07) Form I-797C received, Biometrics appointment scheduled for July 8

07/01/14: RFE for co-sponsor salary and tax info, which was already sent with original package. Resent a copy on 07/08/14.

07/08/14: (Day 32) Biometrics appt.

08/10/14: (Day 65) Noticed that USCIS status has changed from Initial Review to Testing & Interview!

08/21/14: (Day 76) Received EAD/AP in the mail!

09/25/14: (Day 111) Email notice with interview date set for OCT. 29!

10/29/14: (Day 145) Interview day - APPROVED!!!

09/21/16: Mailed in I-751 Removal of Conditions

10/14/16: Biometrics appointment

8/8/17: Mailed N-400 Naturalization Application

8/15/17: USCIS texted that they've received N-400

9/8/17: Scheduled for biometrics 

10/11/17: In Line to be Scheduled for N-400 Interview
6/23/18: N400 Interview (recommended for approval pending I751)

8/1/18: I751 Interview - approved

Three years minus 90 days as LPR, as long as married to the same US spouse.

Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning

April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received

The guides you read said that you have to be an LPR for 3 years and married to the same person for those 3 years. So it's not so much about how long the two of you have been married, it's about how long you've been an LPR while married to that person.

 

So basically, count 3 years from the date you became an LPR and then minus 90 days, that's when you can apply for naturalization at the earliest.

Wonderful, thank you so much for clarifying! Sounds like I had the right idea originally and then got confused. My husband had his green card approved on Oct 29, 2014 so looks like Aug 1, 2017 would be the date we could apply. 

05/14: We were married!!

His card will have a date on it. Resident since ______. Use that date for counting.

No matter when you send the application in, 90 days early, 10 days, or 1day, he can't be a citizen before that eligibility date of three years passes.

You are correct. USCIS ensures this putting the early filer applicants in line for interview typically (most of the time exactly) 1 month before the 3rd or 5th anniversary. Since the interviews are scheduled around 5 weeks ahead of time, by the time the applicant has his/her naturalization interview this requirement will already be satisfied.
