Hi everyone, 

 

We are travelling overseas next month and my wife's green card removing condition application time window is conflicting with our travel plan.

I have couple questions to ask, any suggestion or point of view is highly appreciated.

 

- Because we will be out of the country for over couple months, coming back couple days before her green card expired. should we send the application before we leave ( on August 21st ) knowing that we won't be able to receive the notice or attend the bio-metric fingerprints appointment ?

- or is it still going to be ok to apply when we come back - still within the 90 days window- but a bit too late ?

PS:

We already have a baby- 2 months old -  does it help the case when having babies together ?

I would wait and apply when you're back, but it's far from ideal.

Having a child together does not help, and is not considered compelling evidence.

I suggest to apply before going overseas and have someone taking care of your mail and resqueduling your appointment for later on when you come back, keep in mind that if you're coming back to the country "a couple of days before it expire" and you have to arrive here before it does! What if the airport get closed for weather conditions? You could get here after it expire and they won't let her in without a receipt of a ROC pending.

Cant you apply now? If the green card is expiring in about 3 months, you should be within the time frame.

04/08/2018 - Online Status Changed! - Interview Scheduled!!!

04/11/2018 - Inteview letter on the mail!

05/11/2018 - Interview at West Palm Beach field Office - Approved on spot!!!

I agree with @Mollie09, as long as it's within the 90 day window it doesn't matter and rescheduling biometrics can lead to all kinds of complications - just search this forum and you'll find tons of ppl who thought they had successfully rescheduled only to end up getting a letter of denial for failing to appear. Although I believe most ppl are able to get out of the situation eventually, I wouldn't want to go through that.

Assemble your application before leaving so you can just send the application as soon as you are back.

Cant you apply now? If the green card is expiring in about 3 months, you should be within the time frame.

Thank you. I talked to USCIS this morning and explained the case and they recommend to apply when we come back because rescheduling the biometric fingerprints will cause an issue and it can only be rescheduled automatically and for one time,

Why take the chance?

Can your trip wait until she gets her 10 year green card?

You never know what could happen: things happen and your return could get delayed for unforseen reasons... think about it

Hi, Thanks for your suggestion. 

What we had to do now is change our return date. we'll back on October 30th,instead of November 4th, At least we got about a week before her green card expires. Hopefully everything goes well InshaeAllah !
