Greetings,

 

I recently married my wife who came to the USA from Argentina on a K1 fiancée visa.  We are preparing to submit our Adjust of Status paper work, but have a special circumstance regarding her work situation.  Before she left, the company she worked for in Salta, Argentina offered to allow her to continue working remotely once she moved to the USA.  They will continue paying her via direct deposit into her Argentinian bank account with Argentinian currency.

 

Before looking through the paper work for the AoS, we hadn't thought much about her current work situation coming up during the AoS process.  However, since she has to list her jobs w/ dates on the g325a and there is an explicit question concerning "current occupation" on the I-485 (Part 3-A), we had to do a little research as to how to respond to these questions and any questions that might come up in an interview.

 

After doing a little research on this forum and elsewhere about our situation, it seems to be a grey area for which several people have successfully gone through their AoS process while being transparent about holding a remote job for a foreign company.

 

I saw the names Loki_Go, A'n'L, & bob85 associated with some posts that gave us a little confidence about our situation.  We are prepared to be upfront and transparent about her situation during the AoS process, but are curious if any of you included an addendum to your AoS submission packet explaining the situation?  Or did you simply answer the g325a and occupation question in Part 3-A of the I-485 honestly and that's it (aside from accurately answering questions that came up in the interview)?

 

Also curious if anyone has done this very recently (within the last year), and if so, how things went during your AoS process?

Answered honestly. No extra fuss. No questions asked. GC approved. This was recently, as you can tell from my timeline.

 

Filing taxes was harder, but not impossible.

If it isn't difficult, it isn't worth it.

 

K1 process

9/24/15: I129f sent

9/30/15: NOA1

11/2/15: NOA2

Delayed processing due to work

3/15/16: Medical

4/28/16: Interview (approved)

Delayed entry due to work

8/12/16: POE Detroit

 

9/4/16: Wedding!

 

AOS process:

9/9/16: I485/I131/I765 sent

9/14/16: Received 3xNOAs by text/e-mail (day 2)

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

 

ROC process:

11/3/2018: ROC window opens
