Rejection Notice I-765 But I-485 got accepted

Dear people,

 

Today I received a letter saying that my application for employment got rejected but the I485 adjustment of status that we sent in together got accepted the check is cashed and it shows on the website that the fingerprint fee was received. The website stated that we could file after we got married in the states on my k1 fiance visa the i-485 together with the i-765 application for employment but just today we received that the i765 was rejected because we didnt pay the fee, which was not neccesary if you file it with the i-485. Can someone help me out?

It happens every now and then. Happened to me too, i-485 and i-131 were accepted but the i-765 was rejected because of wrong fee, which makes absolutely no sense.

 

You just wait until you receive the i-485 NOA1 hardcopy and then send the i-765 package back again, with a copy of the i-485 NOA1, a copy of the rejection notice and the green paper sheet on top of all other documents.

 

You can even print out the form instructions and highlight the part where it says that the i-765 is free if you have a pending i-485 if you like, I did. I even sent back the list of fees I got from USCIS in the rejected package and highlighted the part where it says the i-765 is for free.

People make mistakes, especially if they're summer workers who usually don't work there. It's a bit annoying since your application gets delayed a few weeks because of it, but there's unfortunately nothing you can do about it. Getting an EAD or a greencard is not a right, it's a previlege, so I assume we should just be happy to have this option in the first place.

Having worked in government offices over the summer in the past, it's definitely not incompetence. People are hired with very little training and are timed on everything they do. They work long hours and for little pay. The computer systems are antiquated and sometimes simply pressing the wrong key gives you a bad day with no way to fix it until inter-office audit happens. It's a real mess.

 

They have something like 10,000,000 visas to process every single year, and have a staff of around 19,000. You do the math and try to keep up. :P

Hi all,

My husband and I are gathering the documents needed to send away our AOS application as well as the EAD and I came across this thread. I came to the USA under a K-1 visa and after going through the instructions for the EAD, I did not see a location that explained that K-1 visa filers could have the fee waived for the EAD. Could someone explain this further or post a screenshot of this section of the instructions? Thank you!

K1 Visa Process

Nov. 2016 - Applied for K1 Visa
Nov. 2016 - NOA1 

April 2017 - NOA2 (6 months!)

April 2017 - Arrived to NVC

April 2017 - Got the # from NVC

May 2017 - Case left NVC

May 2017 - Arrived to Embassy

May 2017 - Got Package 3 

May 2017- Got Package 4

May 2017 - Interview [APPROVED!]

June 2017 - Visa arrived home

June 2017 - Made it to the US. Finally with my future hubby!!

July 2017 - Married!

AOS Process

August 2017 - Started AOS

August 2017 - NOA1

Sept. 2017 - Biometrics

19th Dec. 2018 - Interview date  [16 months]

Dec. 2018 - GC processing

29th Dec. 2018 - GC arrived home! [10 days!]

I honestly dont think this is really an excuse, but well just ride it out again...

You can obviously find it on the USCIS page for i-485 too. https://www.uscis.gov/i-485

 

Under special instructions:

 

Filing Forms I-765 and I-131 with Form I-485

If you are filing Form I-485 (or already filed a Form I-485 on or after July 30, 2007), you do not have to pay an additional fee to also file a Form I-765, Application for Employment Authorization and/or Form I-131, Application for Travel Documentfor advance parole. You may file these forms together. If you choose not to file Form I-765 and/or Form I-131 with your Form I-485, then you must submit a copy of your I-797C, Notice of Action, receipt as evidence of that you filed a Form I-485.

Did you filed for i130 before and later submitted i485 with i131 and i765? Is your i130 still pending or approved before you submitted i485 ?

you should be able to resubmit your EAD paper without costing you a dime I guess it was a mistake from them ..

Our AP was returned also, same reason, it appears the submit the proper fees message is part of the letter template, we got it too, but called and were told to ignore it

Came in on i-129f got married and sent in i485 with i765 and marriage certificate, i know they screwed the pooch on this one unfortunately its not the first time for me the uscis does this.

Thats very strange, how are you eligible for work in the mean time then?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
