OP then goes in with this; " Where is sense in all of this? So all I said was, well you can try (not possible but I was just being a smartass) but you will be turned away by customs for not having a valid ESTA because of the overstay.

But he doesn't even have a valid ESTA approval. His previous one was made null and void by the overstay. Why suggest he "tries again" to enter? What a waste of several hundred dollars for a flight ticket and a bunch of his time that would be. That's the same as traveling with an expired passport. He will arrive with no legal way to enter the country and will be deported immediately. He won't even be given the option to "withdraw his application" to enter because he won't have made an application!

Hence why my original post says "But CBP will put you back on a plane"  He won't even be given the option to "withdraw his application" to enter because he won't have made an application! 


All I tried to say is that he won't be allowed in the country anymore, even if he tried if he still had his ESTA registered on his current passport. That was my point all along. I did not advise him to go, or anything. Again, to me it looked like OP didn't get the memo exactly that his ESTA is no longer a privilege he can use so me, being a casual smartass, just tried to say "well you *can* try but you won't be let in the US and put back on the next plane available." Maybe I should have worded it a little clearer. Y'all need to get the memo I was just being a smartass about trying. Jeez, cut me some slack. I know how it works. Just let this die, ignore what I said.
