I 485 Rejection: Upgrade to IR

Timeline

Hi everyone,

I am currently residing in the US with my husband. He submitted my I 130 application when he was a green card holder. He is now a USC. My I 130 was with the California Service Center and I sent a letter requesting the upgrade to IR along with his naturalization certificate and the I 485, I 131 and I 765 to the service center.

 

Today I received a rejection letter about "the final action dates" and to heck the monthly DOS Visa Bulletin. This indicates that they are processing the application still as a spouse of a green card holder even though I sent the upgrade request and naturalization certificate together.

 

What should I do? all suggestions welcome.

First I've heard you can do this, but there's lots of info on the internet I found that supports you can...uhm...seems like what you did was correct at least... what does the rejection letter say EXACTLY?

Based on the information you provided, a visa is not immediately available for your priority date. USCIS will accept Form I-485, Application to Register Permanent Residence or Adjust Status, from family  sponsored and employment based applicants according to the monthly visa bulletin that Department of State publishes as a guide for issuing visas at U.S. consulates and embassies.

Hello, I had a similar situation when my mom updated a F2A for my brother to IR. I had setup email correspondence with USCIS so I resend the letter requesting the update, the noa for the F2A, proof of citizenship and email correspondence from USCIS.

Thanks for your imput. How long did it take? How do I set up email correspondence?
