Hello all,

I am not yet eligible for citizenship, my attorney confirmed that I will be eligible to apply next year around April 2018, this marks my 3 year anniversary of holding my green card through marriage. The confusion I have is the Selective Service requirement. I applied for my green card 3 months prior to my 26th birthday, failed to register on my own through simple lack of knowledge that I needed too. I know, I am stupid!  However, USCIS registered for me through my Green card application which I filed in February 2015 while I was 25 years old. I do have proof of registration and a letter from selective service confirming registration. The confusion I have lies in the date on my proof of registration. The proof of registration date is August 10th 2015, which is 2 months after I turned 26 years old, but each time I call the Selective Service they advise me that they received the request to register me from USCIS upon applying for my green card when I was 25 years old on February 25th 2015. They have told me I will also have no problems applying for citizenship since I have proof and USCIS will simply check you were registered, but I am worried because the date of registration is reflecting after my 26th birthday. Does anyone have experience with this and whether this may or may not be a problem? Any input would be wonderful.

I highly doubt it will be a problem since USCIS registered you. Now, what status were you in before you acquired Lawful Permanent Resident status? If you were a lawful non-immigrant during your years under 26, you're fine as well as you were not even required to register in the first place.

02/27/2019: Joint I-751/N-400 Interview.

05/14/2019: I-751 APPROVED.

Naturalization:

12/02/2017: Mailed N 400 to Phoenix, AZ Lockbox. (I-751 still pending)

12/05/2017: Package delivered in Phoenix, AZ. Transferred to Harrisonburg Processing Center.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

Thank you StarKilla09, I might give SS a call tomorrow to further clarify. Prior to applying I was here on the Visa Waiver Program as a tourist. This status expired about 3 weeks after my application to adjust my status so I am un-sure exactly what status I was in. I was definitely in this tourist status for the application itself, but this expired. At this stage, I wasn't really in a status I suppose? Since I wasn't a resident or a tourist anymore. Thanks for your input! :)

Based on what you just said, you didn't have to register in the first place. You'll be fine, don't sweat it. At the moment you sent in your AOS and got your initial notice of action, you were placed on authorized stay and not unlawfully present even though your visa waiver subsequently expired. This authorized lawful stay extended while AOS was still pending until you crossed 26 and no longer required registration which at that point you officially became a permanent resident when it became adjudicated. You'll be fine to naturalize. By the way you can apply for naturalization 90 days prior to 3rd anniversary of being a permanent resident as of "resident since" date on your card.
