Hi There,

 

   Do you mean 38b?  If not, you may wish to check and ensure you have the latest I-129F form, as it sounds like you may be running an old revision.  Check here:

  Regarding your question, this is only if your Fiance is still in the country:

 

"If your beneficiary is currently in the United States, complete Item Numbers 38.a - 38.h"

 

  If your fiance is back in Spain,  You do not need to have their I-94 Information.

Thank you so much!!! you are so kind to have helped me! Im reading it over again and I have realized my mistake. He came to visit last summer for about 3 and a half weeks and went back to Spain.  Do I say that he came as a visitor? 38.a.

Items 37 and 38 are NOT related. Therefore, if your beneficiary is NOT currently in the US, you can skip Item 38.

 

The I-94 can be retrieved here: https://i94.cbp.dhs.gov/I94/

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.
