Hi All,

 

I was once Allowed to withdraw H1B Application in 2013 (i.e voluntarily) i.e inadmissible as per Section 212(a)(7)(a)(i)(i)

followed by visa revoking with 22 CFR 41.122 , followed with Expedited Removal , 235 (b) (1) after Secondary Inspection at Port of Entry(POE) .
I didn't received any future ban to USA .After Secondary Inspection at POE ,I had to wait at the Airport for the next available Flight to
return back to the Home country .

I successfully entered the USA  on an IMMIGRANT VISA in 2015 after marrying a US Citizen after disclosing  whatever happened about the ADMISSION WITHDRAWN & was able to succesfully handle the Immigrant Visa Interview without any WAIVER(I-212,etc).

Iam currently in the process of filing I-751 for myself & I want to do it on my own.

I have the following questions

1) Since I  had to wait at the Airport after the Secondary Inspection , will that staying at the Airport be considered
as BEING DETAINED ( or Does DETENTION only happens if the person is handcuffed) .


2)  How does I  handle Question 20) on I-751  with USCIS such as

"Have you ever been ARRESTED, DETAINED, CHARGED, INDICTED, FINED, OR IMPRISONED for breaking or violating any law or ordinance ?" .

Should I say "YES" or "NO"

Does any of these Terms Apply to me.

1.)  You would answer "YES" because you were detained by an immigrant official (the customs agent during secondary processing), and having been ordered by them to remain in the airport before boarding the next immediate flight, as well as being placed under Expedited Removal.  Doesn't matter whether you were handcuffed or not.

 

2.)  You would answer "YES" because you were detained.

Aug 21, 2017 (Day 37) - Interview Appointment Letter received in the mail, appointment for 09/27/17

Sounds like you have a lot of explaining to do.......maybe this isn't a DIY case.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

May I know  how has anybody's experience in using  a Dept of Justice(DOJ) Accredited Representative's Services for filing

I-751 or any other related Immigration Petitions .

 

Any Feedback on any experiences in using a DOJ Representative for such Immigration Petitions(I-751, N400, I-130)  with USCIS is Highly Appreciated.
