Case Description!

My Mom came in USA on Visit Visa B1/B2, before expiry of law full stay (6 months) we applied for extension. Meanwhile, before expiry of law full stay we have also applied for adjust of status, they accepted all fees including Fees of Figures Print and Figures has also been done last week.

Now we just got an approval for extension which is going to expire first week of Aug 2017.

 

My Question is, considering that we already filed adjustment of status, are we need to file once again stay extension?

Only one stay extension is granted.  You wouldn't get another.  Also, you didn't need to apply for it in the first place with an AOS.  AOS ensures lawful periods of stay until the case has been adjudicated.

We do not file AOS as it is exempted for her, she has file self petition based on her Widow status of the US Citizen!, in this situation what we should do???

As mentioned, once AOS is filed regardless you're in a new period of authorized stay

In my Mom case, she have not required by law to file AOS at all! There is no requirement of AOS for her adjust of status!

From the moment that she have an application pending with USCIS it's like her time here "stoped"...the amount of time that she have been here stop, regardless of the type of visa or extension. She can stay without any problem, even after her extension expire, I recommend that she goes to DMV and get a drivers license wile she still have a regular status on her passport, this way she doesn't have to keep going around with her passport, they usually give it with a one year expiration from date of application, she just need to bring her passport, last I-94, and the letters from USCIS. If she already have a drivers license that will expire with her I-94 just go there with the documents that I told you before to get one valid for a year.

We filed following forms along with appropriate fees for my Mom in end of June 2017;

 

1 - Form I-360 (Widow of US Citizen), we received receipt from USCIS for payment only.

     Any idea how long it will take?

 

2 - Form I-485 (Adjust status), we received receipt from USCIS for payment only.

     Any idea how long it will take?

 

3 - Form I-131 (Travel Document), we received receipt from USCIS for payment only.

     Any idea how long it will take?

 

4 - From I-765 (Employment Authorization), we received receipt from USCIS for payment only.

     Any idea how long it will take?

 

5 - Form I-325a (Biographic Information), we received receipt from USICS for payment, Appointment Letter and Figure Print done two week back.

 

Visit visa B1/B2 authorized extended (1 year year) stay would we expire in first week of August 2017.

 

Please advice above by line, thanks in advance!!!
