I-130 petition approvals do not expire.  If you do not submit all documents within one year of paying the visa application fee, you'll pay the fee again.

Anybody can apply for any visa, but it is highly unlikely somebody with an immigrant visa in process, will be issued a non-immigrant visa.  If you want to see your husband, visit him.

Please clarify.  Does your sponsor claim the girlfriend and two children as his dependents?  If so, his household counting your husband is 5.  $35,975 would be the minimum income requirement for a household of 5.
