Hello All,

 

New to the forum and excited about the future with my fiance from India. We met through work engagements about 5yrs ago and are both divorced; his being finalized more recently while mine was over 6yrs ago. We are crazy in love but have complicated family scenarios.

 

Has anyone run into difficulty with international spouses who were previously married? Any divorced spouses have children who will come at a later date?

 

I am debating whether to complete the ppwk myself (well versed in legal ppwk), use a service or hire an immigration attorney.

Utilize the guides here to draw up and submit your own paperwork. An attorney is not necessary because you'll still do all the legwork and they only mail it out for you.

 

If both of you are divorced, make sure your divorce decrees are available to be included in your petition.

 

You'll also need to have met in person within the last 2 years besides the fact that you've met 5 years ago at a work engagement.

 

Not sure about the children part.

Use the latest I-129F form from USCIS website. G-325A is no longer needed. The current filing fee is $535.

Permanent residents can petition to have their children brought into the US. Keep in mind that if there are any custody orders, this could definitely complicate things (if not make it legally impossible). If they are over the age of 21, this is not an issue.

 

See https://www.uscis.gov/family/family-green-card-holders-permanent-residents for bringing children in as a permanent resident.

 

If you want them to enter with you, you would need to file a K2 visa at the same time as the K1.

After joining VJ I was able to do all the work myself. This place and the people who volunteer their time, knowledge and support to help *is* the reason behind it! 

 

At the beginning I was thinking about a lawyer myself, however after reading the forums here, a clearer picture emerged. Unless you have serious legal red flags (at times plural), most folks here suggest a DIY kinda journey. 

 

I was also thinking about a K-1 visa and after spending a few months reading the forums, we decided it was best for us to go with a CR-1 visa. 

 

That search bar has not been the same since I landed here. ;) I searched endlessly and found so many posts, which contained answers to most of my questions. 

 

Once we began our journey, I plugged in all of our dates and created our timeline -- something you might want to do. It gives your journey definition -- date wise! Once you plug in the first few dates, you can see your estimated processing stats, which really helped us emotionally :)

Thank you for the input. Yes, we have met in person 3x in the last year between India and a vacation in Thailand. I'll be sure to include all documentation re: former marriages and name changes.
