Question about visiting outside country....

Hey all,

 

So we made it! My fiancee was approved and came into the country in late May. We got married last week and briefly made a visit to Niagra Falls for less than a couple hours, not realizing she wasn't supposed to leave the country. We got back in without any hassle but now that we are about to file the AOS we were wondering if we accidentally jeopardized anything by leaving...please advise?

Did you actually go to Canada? Did you have to show your passports to get back to the US? Does she have a new i-94 number?

Yes we both went to Canada and we showed passports. I don't know if her i-94 is the same but the date of entry has changed, though the class of admission is still k1. Does that help?

I think you can still AOS. It would not be in the way that you would not AOS because of the K1, but the regular AOS like when people get into the US using VWP and marry. Is she from a VWP country? 

 

But I'm not 100% sure. It is a tricky case. Did they ask her anything at the POE? Didn't they notice the K1?

They didn't ask her much of anything, they just let her back in. She is not from VWP I don't think (Mexico)? Now I am really worried...it was a last minute plan and it seems we might have messed everything up

 

 

Also they did notice the K1, we told the border agent we were married and just visiting for the day and he let us through.

Look, I just found this old post, this couple also went to Niagara Falls and the CBP said they could go to Canada with a K1.

 It seems that the good thing is you didn't file for AOS before going to Canada!
