Can I lose my kids to my spouse because of my status

My lawyer haven't filed my paperwork yet she still waiting on some documents. My luggage got stolen on the Amtrak recently. Inside the luggage is all my immigration documents and his naturalization cert both my kids social security and birth cert. He is really upset to the point he called up my lawyer and said he wants to stop proceeding. He also told my grandma that he wants to divorce me and take the kids. I'm the primary care giver to both of them since birth. Can he do that since I'm illegal

it is his right to proceed with giving you legal status based on marriage and unless there is documented abuse you can not get legal status without him. or wait till kids are over 21. he can not call immigration and get you deported he can just not help you become legal. as for the kids he has the same legal rights as you to them status is irrelevant however the kids will not prevent you from being deported and there is not a good chance they would go with you if you were.

Actually I'd blame him for putting important documents like that in checked luggage instead of carry on where it wouldn't be out of his sight....but that's not helpful to this thread...

 

Sounds like he's frustrated and mad and trying to get to you where it hurts by saying he's going to put a halt on immigration proceedings for you and divorce, etc.

 

Did you file a report for the stolen luggage?
