Hi All,

 

My parents have been LPRs since Nov 23, 2002. They have been retired for more than 20 years and they retired in China before they came to US on Nov 23, 2002. They have never worked in US after they came to US. They have not filed any Tax returns and I have been declaring them as my dependents in my tax returns.

 

Now, I am going to file N-400 for them and I have the following questions.

 

1. In "Part 8. Information About Your Employment and Schools You Attended", In Question 1, I plan to enter "retired" under "Employer or School Name" and fill in the address and name of the employer in China, and the date of the retirement date in the column of "Date From (mm/dd/yyyy)". And select the corresponding "Your Occupation" from the drop down list box. Would this be good enough or should I fill it in a different way?

2. As for the tax returns, should I attach a note to explain why they don't have any tax filing to the application or should I wait until the interview time to explain if asked for?

You should really put unemployed in the field, as the form itself states...and then just fill in the dates.  They are unemployed for the past 5 years (whether retired or not) and USCIS isn't going to care what occupation they retired from---they will only care whether they are presently working or not for that part of the application.  You only have to list the 5 previous years from the date of filing in terms of employment/unemployment, as stated on the form, so they are not going to care where they worked/if they worked further back than that.

 

As for the tax returns, you don't need to send those in with the application.  Just bring the original IRS tax transcripts to the interview and clear up any misconceptions there in person.

Partly right :)

 

You would put Unemployed under the Employer or School Name, and then list the date as 7/21/2012 (or whatever date 5 years ago from when you actually submit the application) to Present.  The rest of the fields you leave blank.

 

If you look at the form again, it explicitly states they only want you to go back the previous 5 years.  So they mean 5 years going backwards from today's present date.  No further than that.
