First off my wife is on her last day of her visa and we've been preparing the AOS for a while. We're not far from being done but I realized that I do not have my income tax information. I'm going to send for my tax records from the IRS and it might take a while. Is there a serious penalty for waiting until after the visa expires before filing?

-The visa number, the nonimmigrant visa number that they ask for on the I-485 form. Where is that? On her visa there is a number that is alone without any explaination of what it is in red, is that it? Does anyone know how to find that?

-On the biographic information form (I-485) at the top there is a file number and at the bottom there is an alien registration number. What are those? Are they the A number that was given on entry?

-For people that have K1 visas. Should my wife use my Last name or her maiden name on the form?

No. No penalty at all. Loads of people have filed for AOS after their visa expires. You're officially out of status, but USCIS can't legally hold that against you, so it effectively has no consequences.

The number in red on her K1 is the non-immigrant visa number.

The A number should be on the I-129F approval notice. Sometimes it appears on the visa itself and sometimes it doesn't (it doesn't on mine) but should be on the I-129F approval notice.

You can send a copy of what you filed for 2006...you don't necessarily have to send a transcript for the most recent tax year. Sending transcripts for the two previous years is optional and only really beneficial to your case if you're close to the poverty line.

The requirement is to get married within the 90 days, you can file for AOS after with out penalty, many do because of reasons just like you indicated, taxes, waiting for a marriage cert, ect.

As for A# you may find it written on the back of the I-94 card, or on the I-129F approval notice above the beneficiary's name.

Your wife should use whatever name she is going to use legally. If she is changing her name to your then she should use that.
