CR1 Visa interview scheduled 20 days before 2yr wedding anniversary

Timeline

My Canadian husband's interview has been scheduled for 20 days before our 2 year wedding anniversary.  Is it possible for him to obtain a IR1 instead of the CR1?  Should I try and reschedule the interview for a date after the 2 year anniversary to ensure he obtains the IR1?  Please advise.

 

 -  2/29/16 USCIS received initial app

 -  3/2/16 USCIS acceptance confirmation

 -  6/29/16 I130 approved

 -  8/11/16 NVC Welcome Letter received

 -  9/2/16 Barcode sheet/checklist received

 -  End of Sept. 2016 NVC received our checklist's info

 -  11/11/16  notified we were missing info (I assumed I was completing a form incorrectly but after 2 submissions, NVC notified us on 3/24/17, we had been submitting the incorrect birth certificate.  Being an American, having only one birth certificate, I had no idea Ontario issues 2.)

 -  12/15/16  " "

 -  3/24/17    " "

 -  7/17/17  NVC notified us that all documents had been received & they would be notifying us of interview date

  -  7/21/17  NVC issued interview date  (the date is 20 days prior to our 2yr wedding anniversary)

My spouse had his interview Aug. 17 in MTL.  He was issued a 221(g) stating "Documentation of your planned employment in the U.S."  The CO returned his passport, said all else was approved and good but he needed a letter of employment.  On Aug. 18, we used the courier service to mail that and my banking & investment information as well as his bank account info (all totaling several hundred thousand USD dollars).  We did not include his passport with the documents because it did not say to but I'm seeing elsewhere that others mail theirs back.  Should we have included it?

 

I get the impression that all would've been approved at the interview had my I864 been the original one I submitted in Sept. 2016. The reason I kept updating it was because I was submitting the incorrect birth cert., unaware Ontario issues 2 forms, and the I864 was part of the required list - I did not know what was incorrect with my submissions but finally realized it was the birth cert. At the interview, the CO was alerted & concerned I didn't have a 2016 tax return & my most recent i864 was dated March 2017. My CPA told me not to file a return because I spent most of the year in Ontario with my spouse, was unemployed and had no official income. Thus, had the I864 had a 2016 date and signature, it seems like it would've worked out fine. Any feedback on that? I assume at this point, an old I864 would be useless. I'm really hoping his employment letter will be enough but common sense makes me think an I864 must be correct & approved.... meaning I'll likely have to have my parents co-sponsor....?

Because you don't have a timeline I'm unsure from your post who is the beneficiary and who is the petitioner. 

 

If you are the petitioner, and want to use the beneficiary's employment he needs to be currently employed by an employer and that employment MUST continue in the USA.  So he would need a letter from his employer stating why and how this is being done.  They also need his passport to issue a visa and yes you should have sent it.  

 

Honestly using your parents as joint sponsors would have been an easier time for you especially since you had no income in 2016.

  • Aug. 17 -  Montreal interview, passport returned & 221g issued (requesting employment letter)
  • Aug. 18 -  Requested docs mailed to MTL
  • Aug. 25 -  Status changed to "READY" on CEAC website & email received with directions to mail passport to MTL
  • *We had to make an emergency trip to the US Aug 26-Sept 4
  • Aug. 30 -  Status changed to "ISSUED" on CEAC website
  • Sept. 5 -  Passport will be mailed to MTL 

This seems to be very good news. I hope my spouse receives his Visa & passport within the week to 2 week time frame others have mentioned. Sept. 5 is our 2 year wedding anniversary. Should I include a letter with his passport reminding them of that and request a IR1 Visa versus the CR1 he is scheduled to receive
