(asking for a friend) annulment and coming to america

I'm following along here and Hank is spot on. The fact that they got divorced in Japan and she has a copy of the divorce papers she can file for a K1 (which by definition is a marriage that will take place outside the Philippines which is perfectly legal) and present the Japanese divorce papers (of course they will need to be translated to English as Hank has stated) to the interviewer. Lots of people have gotten approved using this procedure and IS accepted by USEM. NONE of the documents for any part of the processing of the visa requires a "red ribbon" be attached. NONE.

 

Have them file for a K-1 and they will have no problems.  You can search here on VJ and see many who have been approved using this same logic.

The Recognition of Divorce requires a court process, a lawyer is best to have.

Does the Philippines even honor divorces from other countries?  I know friends who have had to annul in the Philippines even though they got divorced in Hong Kong.  Come to think of it, their marriage took place in the Philippines...

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Answer is sort of like those adult diapers.  Depends.  The Philippines will recognize divorces from foreign countries IF the foreigner initiates the divorce.  If the Filipino initiated the divorce .. no recognition.  

 

Still requires a court process.

You are a wealth of knowledge. In my case, she is annulled so I am lucky there.

Everyone. I told my friend about this post. and her boyfriend is planning to file for K1 visa now. She have more questions. LOL. so her boyfriends last visit in the philippines was 2016. does he need to visit her again in order to file for K1 visa?

Just needs to be able to prove that he has visited her within the 2 years prior to the interview.  He can file now. Waiting will only cause him to have to make another visit. Of course he can go to the Phil as many times as he wants. Must keep track of all receipts and pictures to prove his visit and that there is a bonafide relationship.

Thank you. he's planning to visit soon before filing. so i just found out that the boyfriend is DUAL CITIZEN (filipino/american) . is he still allow to petition?

Requirement is to have met in person WITHIN 2 years of filing the Petition.    Was there last year, all should be good.

Yes.  He is a USC and that is all that is necessary.

She can't get her name changed to her maiden name unless she has DOCUMENTATION from PSA showing she is now single.  Which she doesn't.. and can't get.    She will have to keep using her passport with married name.. no option for now.

so its okay if the last name on the passport is different from the petition papers?
