Wife (abuser) Wants to Leave America. Can She?

RECAP...

So the wife was arrested in April for domestic assault, charged by the State of NC. She has a six month protection order against her, and a one year by the State, along with attending abuse and anger classes. As far as I know, still no SSN and definitely not the AOS.

Now, does my sponsorship for her become invalid the night she was arrested and basically kicked out for the last time?

Is there anything keeping her here and not able to return to her home country?? My pastor said she told him she just wants to go back to her family. Am I keeping her here in anyway? My sponsorship of her or anything? The only thing I think that can stop her is they will not let her leave the state, but I do not know.

since there was no aos you have ZERO  responsibility for her the i134 has NO LEGAL WEIGHT.

 

she most likely found out that since she came on a K1 the ONLY way for her to become LEGAL is through YOU and the i864 is the ONLY financial form that is LEGALLY INFORCEABLE. from your previous thread I still advise you to stay far away from her and keep your children safe she is not worth more than them and remember what she did to you and your family.

 

stay strong and stay away from her you owe her nothing and she is free to go at anytime.

Did you ever cancel the AOS? File for divorce?

Lemon, we did not have the funds to start the AOS at the time, as rent went up and car needs repairs.

As for divorce, as far as I know, have to be separated for one year from last day living together, and that be the day in April of her arrest.

As long as there's no warrant for her arrest, I guess she's free to go home and you're free from her then.
