FORM I-130 FROM MEXICO

Hi, I was born in USA, but I´m living in Mexico; Can I apply to form I-130? My mother is living too in Mexico

If you are a US Citizen (and at least 21 years old), sure. But know that you will need to establish domicile in the US - you can't sponsor somebody for a green card and live abroad since the purpose of the visa is family reunification. You may also need a joint sponsor for the I-864 (income from a job in Mexico very likely won't qualify).

No, I living in Mexico since I had 3 years old, 10 years ago she tries to apply for tourist, put wass denied because she need to apply for residence

There's I way she travel to USA? she dont want to live there, just want for visit my uncles; 10 yeas ago she tried to get tourist visa but was denied because she need to apply for residence

If she only wants to visit, then she needs a tourist visa. She can apply again if she has sufficient ties to return home. But there's no other visa to go for, and getting a green card requires that she will reside within the US most of the time or else she will have the green card abandoned.

Ah that makes it a difficult situation, like the other person said above, you have to establish domicile.

Why did they say she needs to apply for residence instead of tourist? Was her intention to stay?

Because that's what they believed her true intention to be.

For a tourist visa she needs to put together a lot of evidence that she intents to go back to Mexico after the visa. Usual evidence is:

 

- Job letter saying she is expected back

- 6 months of pay stubs for job

- Lease or property ownership 

- Other things, like taking care of her parents (?)

- etc.

If I do the request could be attach a letter explaining that she want move to usa for leave with my uncles, because I gonna move to usa time later?
