Help with i-485 from K1

Hi everyone.

 

Sorry for this potentially irritating post asking for help, but I've spent a very long time looking for answers that relate to the new i-485, and I'm coming up dry. I'm filing AOS from a successful K1, and I'm a little stumped on the following:

 

- Part 1, 22.a: When I last arrived in the United States, I was inspected at a port of entry and admitted as... 

(I'm not sure what to put here, as the categories they give - student, visitor, exchange worker etc - don't apply.)

 

- Part 1, 24: My current status.

(Do I put "K1 nonimmigrant" here, or is there something else that I need to enter as I'm now a conditional resident?)

 

- Part 2, 3: Receipt number of underlying petition.

(As this AOS is a result of my I-129F petition, do I need to put that receipt number? Or does this question refer to something else entirely?)

 

- Part 6, 1: Information about my children.

(I now have 2 stepkids, as a result of my marriage per the K1. Do I add these to the form, or do they not technically 'count' due to them being my stepchildren through the marriage relating to this AOS/visa case?)

 

I know I'm asking for a lot of help here! Sorry - I hope someone that has already filed from the same position as me can give me guidance.

01/18/17 - I-129F mailed to Lewisville, TX

01/25/17 - NOA1

05/05/17 - NOA2 (100 days from NOA1)

05/19/17 - NVC received and case number assigned

05/26/17 - Case left NVC, status 'In Transit'

05/30/17 - Medical

05/31/17 - Consulate received 

07/13/17 - Interview, APPROVED!

07/21/17 - Visa in hand

07/22/17 - POE Newark, successful

08/02/17 - Married

08/23/17 - AOS filed (incl. EAD and AP)

08/31/17 - NOA1 date on AOS packet

09/21/17 - Biometrics appt

10/16/17 - Online tracker says 'Ready for Interview'

11/09/17 - EAD and AP approved

11/16/17 - EAD/AP combo card arrived

12/19/17 - Green card interview

12/22/17 - RFE received (medical had been lost)

01/23/18 - Green card in production

I'm surprised anyone would use the new I-485 when the old one is accepted until 8/25. 6 pages vs.18 seems like a no-brainer to me. Plus the new I-485 has over 40 pages of instructions.  You only need to include a G-325A which is simple. I have the PDF file if you want it.

Whilst the instructions said the previous edition could be used until 8/25, it is always better to use the latest edition to avoid any problem. There have been cases whereby some clueless USCIS employees actually rejected previous edition forms that were allowed and asked for the latest edition.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

K Visa because it doesn't allow numerical characters here

 

- Part 1, 24: My current status.

Either that or K-1 visa holder

 

- Part 2, 3: Receipt number of underlying petition.

I-129F receipt number that begins with WAC

 

- Part 6, 1: Information about my children.

Enter the details and state the relationship as 'stepchild' and check no where it asks if the kid is applying with you

 

I know I'm asking for a lot of help here! Sorry - I hope someone that has already filed from the same position as me can give me guidance.

Normally I would agree with you. But in this case the extra scrutiny in the question section would make the old I-485 a better choice for many. I wouldn't lose any sleep over the use of the old form. Especially if it was mailed about three weeks before the deadline.

Thank you for your offer, but I think I'm going to play it safe and use the new form. I most likely won't be filing everything for a couple of weeks, and I'd be very nervous about it being so close to the deadline. If there's a delay with the mail, or a misunderstanding with the agent processing it, I'd hate to have to start all over again. But I really appreciate you offering your PDF :-)

I have started drafting my forms. I have trouble typing in some fields so for those I will print and write. Make sure your handwriting is legible :D

You're definitely not the only one. You'll face the same problems with other USCIS forms too at some point so just do the same - print and write with black pen :)

I have been using pdf on Mac, this system made numeric (like SSN) numbers not be in the exact field location. Tried opening with Google Chrome App and it works better, although 22.a. is still a non typable field :)

The forms can be quite silly. Never know what fields might give you problems until you start typing. LOL.

  • 1/28/2019 7:06 pm Package Delivered to Chicago PO Box
  • 2/1/2019 Credit Card Payment Pending Showed Up
  • 2/3/2019 Credit Card Payment Completed
  • 2/4/2019 1:00 am Received 3 Text Message Notices (there's supposed to be 4 notices, but 1 was missing for some reason)
  • 2/7/2019 Received Four I-797 Receipt of Notices in the mail
