Marriage ceremony on a k1 visa

My girlfriend and i just got engaged, i know we will have to file for a k-1 visa and have been prepping for that. She just voiced to me that she would like to have the wedding in her home town of rosarito mexico. With the k-1 visa, we have to be married in the states correct? And if we wanted to have the reception in mexico what form would she have to fill out so we can have the wedding and reception on the same day? Any advice would help! Thank you all in advance!!

I don't think you can have the wedding and reception in one day.   When you arrive on K1 you are not able to travel out of the country right away.

She will only be able to leave the country after having ap or green card in hand. Both can only be obtained after marrying and filing for aos and ap. Ap usually comes first, around 90-120 days after filing

 

so, no, there's no way to have a ceremony out of the country on the same day you get married. You can certainly plan to have a party after she has the appropriate docs to leave the country

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

My gf and i are recently engaged, she wants to have a wedding in her home town in mexico, if we get married in mexico, is she not allowed in the states until the k-3 is completely filled out and accepted?? We were going to go the k-1 route but she doesn't want a wedding or anything if we can't have her friends and family there and most people wouldn't be able to come to the states for our wedding. Btw i live in Massachusetts and she lives in rosarito so the distance is difficult.

Timeline

The distance is difficult for anyone in a long distance relationship. If you get married in Mexico you can file a CR1 visa and it would take her 12-24 months to come to the US to be with you.

True that, so we should just go for the k-1 cause it should be quicker? Is there anyway possible that we can have a reception in mexico after we get married?

Does she have a tourist visa to visit you in the US while the process is going on?

 

If not, then, yes, she has to stay in Mexico for up to a year or more until she gets a green card. 

 

If she does then she can visit you for the short time allotted for her visit but she will have to return to mexico to complete the process.

 

ETA: Just saw your new post. If you do the K1 she will not be able to exit the US until she Adjust her status. That will take an additional 3 - 4 months. So a reception is highly unlikely. People see the K1 is shorted but overlook the restrictions it has. When you choose a K1, the immigrant can't leave the US, can't work, and in some case can't even get a driver's license until they adjust their status, which takes 3 - 4 months after marriage and cost an additional $1,200+ dollars.

If you do K-1, you'll still need to get married at least in the courthouse in the US in order for her to file AOS, EAD and AP. After getting her AP, you guys can travel to Mexico and have the reception there.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

So is it at all possible to get all the appropriate paper signed and filed out for us to be married, get "married", go to mexico and have a party, but not submit anything till the following day? Or is it once she gets the k-1 visa and she crosses the border, she can't return to mexico until the k-1 expires or we are married?

i know how important this is to her and am trying to figure anything out that gives her the wedding she deserves.

It is fraudulent to have a ceremony and papers signed before entering the us

once she enters the us she needs to get married within 90 days here. The k1 is a one entry only visa. She can't come in and then leave without the proper docs (ap or green card as already said) or else she won't be allowed back in

if having the wedding outside the us is so important, the k1 isn't for you
