Moving to different states as a couple

Hi experts. Please my wife and I are moving to America. She's going to New York and I want to go to North Carolina is it possible? Since we're couple we don't want to stay together with someone who's also a couple in New York. So I want to go to North Carolina and find apartment so that we can live together. Can this situation raise a question at the point of entry since we're all moving to different states as a couple? Besides can she move before me or unless we go together?

We are moving with a dv visa. She's the principal applicant

If she's the principal applicant she has to enter before or with you - you cannot enter first without her. 

 

I've never heard this asked. It's a free country of course, but it's possible moving to different places might raise questions of if it was a green card marriage only, if anyone picks it up?

This sounds very strange, I think it maybe wasn't explained clearly, so you can imagine if they hear this story there will definitely be flags.

It sounds like you both intend to move to the states and not be together at all.

But maybe you're saying you're going to find a place to stay in North Carolina for the both a you?

The story will have to sound more convincing.

Welcome Letter: 9/15/2017

Received and Paid AOS: 9/15/2017    AOS payment cleared my bank: 9/19/2017 (still shows In Process on CEAC)

Received and paid IV bill: 9/19/2017    IV bill cleared bank: 9/21/2017

Requested Expedite: 9/20/2017

AOS and IV show as paid: 9/23/2017

DS260 unlocked: 9/23/2017

Partial Expedite Approved at Counselor Level: 9/25/2017 (Must still wait out NVC)

Scan Date: 10/2/2017    Case Complete: 11/15/2017 (6 weeks 2 days!)

Case sent to consulate: 11/20/2017     Received by consulate: 11/21/2017 (11/20 was a holiday in Mexico)

Interview Scheduled: Jan 2nd - I managed to get someones canceled appointment the very same day my case status turned to Ready.

Biometrics: Mexico City Dec 27th Medical: Mexico City Dec 28th

Case says READY but consulate says case is not in system, I jumped the gun and booked an interview but they say its invalid until I receive the letter so I might have to cancel it.

Appointment Letter: Flew to Juarez just to get this, its actually 2 letters you need.

Interview Day: Jan 2nd   Interview Result: APPROVED

Tracking Number Received: Via email notice and website the afternoon of Jan 4th    Visa Delivered: Friday Jan 5th Mexico City

USCIS Notice - Green Card mailed: 3/28/18

Yes to find a place to stay together. The one we are going to stay at in New York is a married person with kids and we can't be together in the same apartment. But I have a friend at North Carolina which I have explained to be with him for a while to look for apartment. My wife will come with me after I have gotten an apartment.

Ok SuSie. She will enter first  but will it be possible for us to take a plane to New York and North Carolina respectively?

These guys are diversity lottery winners.  The basis of their immigration isn't marriage.  It's not an issue here.

 

OP, as SusieQQQ said, she will need to enter first as the principle.  USCIS don't care if you live separately for a while.  Just be sure to update them on your address if you're planning to change it.

You both should fly to new York and spend at least a month there then take a flight to NC. Else it will be possible for both visas to be cancelled at POF .

What nonsense. Who is going to check on how long they stay together in New York?

 

There are no conditions on the spouse visa of a DV other than first entry with or after the principal.

Sorry Sir, that is not nonsense . that's what to do to not bring suspicious. Why file as couples and now flying to diff states ? I have read stories and watched a lot of documentaries about POE suspicious of officer and such story is one of them. you can check up this on Netflix.

Because this is not a visa based on marriage, it's DV. I understand you did not get this type of visa, so maybe on your IR/CR visa you have to be worried about what is suspicious. DV is a different type of visa. They won't even be asked about their relationship at POE and probably not about anything else either. All we were asked was whether we wanted to keep the address for our green cards or change it. 

 

And it is total nonsense that anyone would keep tabs on how long they stayed anywhere together before one of them moved. For your information, they could divorce a day after arrival and it would have no effect on the spouse's green card because with DV it becomes unconditional on entry. Please give me one, just one, actual example of uscis checking up on a DV case. Netflix? Really? I certainly enjoyed Stranger Things, but I'm not sure what it has to do with immigration to the US.

Like Susie, said that is indeed nonsense. A DV spouse can enter the US from any POE regardless of that used by the main selectee as long as the main selectee enters before the derivative.

   Living apart is sometimes needed in modern times with the job market being what it is.   Hopefully you find a place quickly so you can reunite.    If you were a marriage based green card recipient you would get a LOT of extra questions which is why the responses have been the way they are. 

This will not be over quickly. You will not enjoy this.

But it's not a marriage based card, and people should take a few seconds to bother to see what forum the case is in before scare-mongering and giving inappropriate advice.
