Hi All,

 

"very critical situation" A US citizen applied for his 34yrs unmarried daughter (but she was married) its happen because very unprofessional immigration consultant suggested fast root to get his daughter in US by showing her Unmarried, Long story short Embassy found out after inquires that applicant is married and is not eligible for Immigrant visa. what will happen next she haven't receive the decision yet, will she be barred to enter US forever. Is US citizen will be in trouble any reply is highly appreciated.

They should sue the immigration consultant.

 

I am not sure if she would be allowed to apply again, but even she is able to start the process from scratch the wait is 12-13 years.

 

Misrepresentation can lead to a permanent ban and it is a serious offense. There are waivers available for children of US citizens, but they take time to be decided so basically add more time to the 12-13 years of the visa. They are looking at a very very long time.

Well, the daughter will have a very tough time in the future if she tries to even attempt for a tourist visa. It's even more difficult now that she has shown immigration intent and lied on the application. She has zero credibility at this point. As for the US petitioner, he submitted the information under penalty of perjury. There might be some legal implications.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

Material misrepresentation/fraud is usually a lifetime bar for which there is a waiver available that she may or may not qualify for.

 

The family is just as culpable as the "consultant" if they went along with something they clearly knew was untrue.

I completely agree it's like you're been judged for a crime that you didn't commit and your "lawyer" says that the fastest solution is to kill the witness. If you do, the lawyer won't be convicted for murder, you will!
