I will make the background in bullet points make things quicker digest.  Wife is American and husband is Scottish. 

  • Jun '14 husband visits on VWP. Husband and wife get married.
  • July '14 husband returns to Scotland and i130 filed for CR1
  • Oct - Nov '14 wife Visits husband
  • Jan ' 15 husband visits on VWP with an intent of 89 day visiting
  • Mar '15 Wife becomes sick and is hospitalized for 4 months
  • Apr '15 husband has now overstayed 

It is now summer of 2017 and I, the wife, have now recovered of my illness and have a job that I can support us 150%+ above the poverty line finally. I have researched a bit, but nobody I have seen has overstayed as long as my husband has and adjusted status. Any advice is appreciated.
