VAWA applicant - Can apply for Victim compensation?

Hello all,

 

I am a I 751 abuse waiver applicant. Can I apply for victim compensation?

I was diagnosed by PTSD and need to go through therapy sessions.

 

I do not have insurance as my spouse canceled it. So, my therapist suggested me to apply for Victim compensation program.

 

My question is can I eligible to apply for that?

Taking help from Government will be a remark for my immigration file?

Will that be a reason to deny my PR application?

 

Please help, if anyone have any idea about this.

I honestly dont know for sure. I have used the victims compensation before but Im not a VAWA filer. Each state has its own program so a lot is going to depend on your state.

What I can tell you:

It is not considered a public charge.

You need to be the victim of a crime. So you need a police report of the crime.

Therapy may not be a covered item.

 

Call the victims compensation hotline for your state and speak to someone to get the answers.

 

If you have no insurance see about if you are eligible for Obamacare or medicaid in your state. If not use google to find low cost health clinics near you. Some therapists offer sliding scale.

As an LPR, (with or without conditions) you do have rights to government benefits so long as you do not claim to be a US Citizen to gain them.  USCIS would deny your application (based on the compensation program) only if you purposefully posed as a US Citizen when applying for victim compensation.

Sure will do. I am from CA.

 

I already spoke with victims claims coordinator. She said, I am eligible.

But, I am only doubtful it it comes under public charge, as I am getting help from Government.
