DS-160 mistake

Hi there I filled in No for this question since I didn't consider my fiance being a immediate relative. Do you think it is a mistake from me filling in no? I already confirmed my DS-160. They say I need to do this: 

'For all applicants: if you made a mistake answering the questions about your family, education, travel, or any security-related question, you must complete a new DS-160 form and print a new confirmation page.'

 

Is that really necessary because I send back my packet 3 already with my DS-160 copy to the consulate..

no, i don't think so. your fiance is not an immediate relative until you get married.

 

EDIT: but just looking now at the help section to the right, they reckon a fiance is an immediate relative ? Weird.

Sample form on here marked that question as a 'No'. However, I actually marked 'Yes' because a fiance is considered a relative when I referred to the corresponding question's help section. After marking 'Yes', there was a follow-up question asking if the person is a US citizen, LPR and some other options. 

 

However, I think both 'Yes' and 'No' would be a non-issue since we'd have mentioned the US petitioner as a fiance in another question in the DS-160. 

 

If you look up older posts on this very same question that you're asking, you'll see there has always been a mixed consensus. Neither had issues with whichever answer they selected.

 

I disagree with some people when they say a fiance is not a relative or that the question only covers a non-US citizen or non-US LPR fiancé. A fiance is a fiance regardless of US status. Also, some people say that the question is aimed to figure out if the visa application is an "orchestrated move" to bring someone in by visa fraud. Trust me, the US government agencies will run checks and they will find out one way or another, with or without a DS-160. Just make sure you have only one fiance who is the US petitioner of your I-129F and no other fiance or undivorced husband/wife lying around somewhere.

 

Your 'No' in your original DS-160 won't be a problem. Don't fret. Focus on gathering your required paperwork for the interview now instead. And no, USCIS doesn't deal with DS-160 nor would there be any RFE for it. The only people have any rights to ask you to correct something now would be the consular officer or the embassy in general for the K-1 interview stage.

Any mistakes you make on the DS-160 can be corrected by doing a new DS-160. If you do a new DS-160 bring the confirmation page of the corrected one to your interview for presentation to the CO. The first one is considered DEAD.

I could make a new DS-160 because I still have a choice which one to fill in on the ais.usvisa site to make the payment. In my country we have to send back the confirmation that you're ready for your interview, with the DS-160 copy included. Would you recommend me to make a new one because they have my old one already or will they simple replace the old one since I paid for the new one?

I think it's a non issue. If you're proving US domicile, your fiance will obviously be living in the US. If an actual human being stops you up on that kind of question, they'd be the most ridiculous person out there.

I mean the entire purpose of the form is to marry someone in the US...... not another alien resident.

 

Fiance is NOT an immediate relative. This is why we don't file IR-1 visas. That wording is just plain wrong, and I'm positive it doesn't matter either way. I marked it no, and will not resubmit that form.
