Hi, I have recently been approved by USCIS to sponsor my fiance here in the US. We are still awaiting a interview date for her. My question is, once we are approved and she gets the K1 visa, could we have a wedding ceremony in Canada for her family and friends and soon after the weddinv sign all legal documents in Canada by an ordained minister from the US (Indiana). Then once we have crossed the boarder the following day, could we just date the certificate and send it off?

One of the main requirements of the K1 visa is that you have to get married in the US, within 90 days of arrival.

If you get married in Canada, then your K1 visa will be invalid. You will need a spouse visa to move to the US.

 

Now imagine that somehow you will slip through the border on the K1 visa, already married in Canada. Immigration officials will notice that once you file for adjustment of status based on your K1 visa. What do you think will happen then?

No, if you wanted to get married in Canada you should gone with a Cr1 spousal visa.

 

Now the natural question you may have is "how will they know?".  Trust me, they always know and your future wife's status in the U.S. could very well be striped.  Is that a risk you are willing to take?

We wouldn't be filing anything with the Canadian government, and we wouldn't be staying there in Canada. All I wanted was to do ceremony for her family then come back the next day and either go to the justice of peace to legalize it. But if it's a bad idea then I will not do it. Oh and I wasn't talking about getting married before the k1 is approved, I was speaking about once the k1 is approved and she has the okay to come into the state's and marry.

Yes, she's okay to marry in the US, not Canada.

Signing legal wedding documents in Canada, would mean getting married in Canada.
