Need help.

I'm a USC and married with a 2 year old infant. I filed I-130 for spouse. Spouse was arrested by CIS during interview process for I-130. I-130 was approved. Spouse is incarcerated and facing deportation now.

Once deported I will have to file for 212 and 601 to bring spouse back to the US.

My question is how long can this process take and what are our chances of getting approval in this scenario?

Thank you.

Depends on the country and where the waivers are adjudicated. You will not file the waivers until denial at the interview in his country. Could take 6 months to more than a year. I would definitely consult attorney Laurel Scott www.visacentral.net so you are 100% clear on exactly what you need to do, how long it will take, and whether or not he will be approved.

Congo it seems.

Never seen anyone post from Congo, have a look in the regional forum.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Hello, sorry for your demise! If you are already married, why can't you adjust his status?? Sounds simple, but maybe there is more to the story. The biggest thing most lawyers will tell you is "Don't let them leave!" It is much harder to fight if they are gone, and once they leave, that is when the ban is actually triggered. Get help now, don't let him go! Mine left because he was tired of sitting in immigration detention, a decision he now regrets. Good Luck my dear!
