Maybe he got divorced before he entered the US and because he was not in a relationship at the time of applying for the visa, he declared himself as single.  I have seen a few divorced people who class themselves as 'single' and someone has even asked me what to write on a form when they are divorced but not in a relationship.  My reply:  divorced.

I'm from the UK, hubby is from Michigan and is a retired US Army LTC.   We are currently stationed overseas.

Here is our immigration journey so far....

10.26.13 - Our wedding in Scotland 

11.26.14 - Filed I-130 at US Consulate, Frankfurt (DCF)

11.18.14 - Returned to Scotland to renew our vows for our first wedding anniversary

01.08.15 - NOA2 received in snail mail, together with case number and Packet 3 instructions

02.15.15 - Submitted Packet 3

02.17.15 - Packet 4 received by email with instructions to schedule medical and interview

02.18.15 - Email authorisation received from Consulate to gain access to appointment calendar

03.03.15 - Medical

03.18.15 - Interview - Approved

03.21.15 - Visa in hand

06.10.15 - POE Chicago (final destination Detroit)

07.20.15 - Received SSN in mail

07.27.15 - Received 2 year green card in mail

10.05.15 - Returned to Germany on government orders

05.25.17 - Mailed ROC package to California Service Centre

06.14.17 - Received NOA 1 (dated 05.30.17) in mail

09.05.18 - Received a second NOA (dated 08.11.18) in mail granting a further six months extension to green card due to 'processing delays'

11.26.18 - ROC - Approved

12.05.18 - Approval Notice I-797 received in mail

12.18.18 - 10 year green card received in mail

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

A lot of "visa advisors" have people pay them for advice then turn around and ask the question on VJ. Happens all the time.

nothing at all 

we have to bare our souls, our financial information, our past (school and college), our family info

everything even things i didn't thiink was any of their business like when CO asked my husband if he slept with me

The reason people are asking how he got a green card/citizenship is because if he got it though marriage to a US citizen, there's a wait time before he's able to petition for someone for a fiance or spouse visa. He probably knows this, and is why he lied about being married before. They'll find out. Or, if he got to the US based on a status where he had to be unmarried, but really *was* married at the time (unmarried sons and daughters of USCs) then he could be in an even bigger pile of trouble, and so he's lying about it.

 

Or, he's simply being an idiot about "wanting to forget the past" so badly that he'll lie on a federal application. But that doesn't seem likely. 

 

I'd say your friend has got a real problem right now and quite frankly, should just ditch this loser who is clearly up to no good. If she wants to persist, she needs to get him to go to a lawyer now and have them walk him through how to fix this. This is probably a bit out of the depth here.

Marriage/ AOS Timeline:

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

17 Feb 2015: NOA1 "Received Date"
19 Feb 2015: NOA1 Notice Date
08 Aug 2015: NOA2 email! :luv: (173 days from NOA1)

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

25 Aug 2015: NVC Case # Assigned

31 Aug 2015: Left NVC for Consulate in San Jose

09 Sep 2015: Consulate received :dancing: (32 days from NOA2)

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

The recent case was for white lies as it were things that happened but if you had been honest it wouldn't have prevented you getting that visa or being allowed in or getting citizenship.

 

This is different, pretending you are single when you are not for an immigration benefit where the immigration benefit would have been denied had it been known will most likely be seen as material misrepresentation. You can get your citizenship revoked if it was granted based on a lie that would have meant that you would not have been given your original visa. 

whoah. thats going to be a hard case.. i guess.. advices them to just better get a lawyer and do something this early or they might regret it..

i mean on her part. i took the part for her. coz as i said. torn she dont dnt know whats the best thing to do right now.. and i think ive said the full story/situation in the first place..

yeah. thats the best thing i can tell them too. well excuses made, she said he thought that doeasnt count because that before he came in the US. i think if he only made an honest mistake then there wont be a problem at the beginning..
