Can a F4 Principal Beneficiary apply and get visitor visa of USA

Hello Everyone,

 

Please I need some clarification for which I need help from your guys. My family members is principal beneficiary of F4 category with PD: 24-12-2014.

The principal beneficiary intends to visit relatives in the USA.

My question is can a principal beneficiary of F4 category apply and if, everything goes well secure a visitor visa for USA to visit relatives?

yes of course they can try. if he or she gets it, they can never overstay, but sure they can always try, since it's a long process

 

never lie to the officer and the petition has to be disclosed

The answer to your question is Yes. A Principal Beneficiary can apply and secure a visitor visa to USA inspite of having F4 immigrant visa case in pending. In fact he / she have more chances than others of obtaining a multiple entry visit visa to USA.

I disagree that he/she has better chance to get the visit visa. The CO will have to judge if the person applying for visit visa has strong reason to come back to his/her country of origin. They don't consider pending IV petition as a criteria to grant visa.
