I am a Canadian citizen who married my husband in 2015, and we had a rough patch and did a summary dissolution which just got processed February 2017.

 

I did not end up moving to the US and we did not apply for any work or residency visas for me after getting married.

 

Now we are reconciling and he says that there is a 36 month lockout from the date of the divorce finalization before we could apply for any work or residency visas again.

 

I'm wondering if, given the circumstances that we didn't apply the first time, and I am remarrying the same person - would there still be a lockout?

 

Any help much appreciated!

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

Why the hurry? You just got the divorce from him finalized. I'm no expert but I am pretty sure immigration is going to want to know why you guys got divorced and now you're back at it again. So if this is genuine, and this is something you want. Slow down and gather evidence that you are a genuine couple and not getting back together just so you can move to the US. 

 

Take the time to spend a lot of time together to figure out what you guys really want for the future.
