I-130 after entering on k1 married and returned to home country without adjusting status

Timeline

Good morning,

My wife came to the US on a K1 visa and we married here in the US within 30 days.

She returned to her home country without adjustin status to a permanent resident.

Do I have to file an I 130 to bring her back? Do we have to through the medical and biometrics again?

any help will be greatly appreciated.

Timeline

Since she left the country without completed AOS, you have to start all over again by filing I-130. It will take 12-14 months (may be longer, depends on your country).

New petition, new fee, new biometrics and new medical. Big mistake to leave without AP.

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

The big question is why did you guys do it?

Now you have to apply for Spouse Visa and the process is usually longer than the K-1.

09/27/2016 - Last Arrival on B1/B2 Visa

02/01/2017 - MARRIED!!!

05/28/2017 - Package Sent

05/30/2017 - Package delivered 

06/09/2017 - Package returned (outdated I-130)

06/12/2017 - New package sent

06/14/2017 - New Package delivered

06/20/2017 - Check cashed

06/21/2017 - e-mails and texts received

06/24/2017 - Notice of action (Acceptance letter) received in the mail.

06/30/2017 - Biometrics appointment received in mail.

07/03/2017 - Biometrics done! (it was a successful walk in, my appointment was 07/10)

09/02/2017 - Service Request for EAD.

09/25/2017 - Call to tier 2 after no update on SR.

09/25/2017 - New Card Is Being Produced!!! (YAY)

09/30/2017 - EAD in hands!!!

04/08/2018 - Online Status Changed! - Interview Scheduled!!!

04/11/2018 - Inteview letter on the mail!

05/11/2018 - Interview at West Palm Beach field Office - Approved on spot!!!

We are same, you will start all over again by sending I-130 form...I been in US via K1 visa two years ago, got married in US and returned to home country. I applied IR1 last year then I got my visa last month. Overall processing for me is 8 months. On the interview, the consular asked me, "Why comeback to Kuwait? Why I didn't apply AOS? Good luck to you.
