Hi,

 

I had my biometrics in mid June. I am hoping the EAD will come within another 30 days or so (max) from now. However, I just checked the stats for processing times for the Baltimore field office and they do not look good! Average processing time for AOS, from Biometrics, is over 200 days! It also says they are processing cases from May 2016.

 

The reason I'm posting is that me and my husband will be travelling in November to Europe, and again at Christmas to go to see my side of the family. I didn't apply for I-131 with my AOS/EAD because at the time we had no firm plans to travel so I couldn't put a date on it. Now that I know when I'm looking to travel, should I apply for my I-131 now? Anyone know how long they take? Also, can I apply for 2 at once, as I know when we will be making both trips? I had hoped to get my green card in the summer and visit home then, but that seems really unlikely now. 

 

Finally, I'm guessing the EAD does not give you the right to travel?

You have the possibility to be approved for GC without interview since you are a K-1.

 

That said yes apply for your AP card. Send in a copy of your NOA1 from your AOS and your fee will be waived. It will still take 3-4 months from when you apply so you better send it off quick. You only send in only form for one AP the card can be used more then once.

Brilliant. Thanks so much for that response :-). My case does say that my application (AOS) is 'ready to be scheduled for an interview' so I just assumed that meant I would have one.

Yes then you are going to have an interview at some point when they are ready.

Ok cool. Thanks again. Just wish the Baltimore Field Office didn't have such terrible stats for processing times. Over 200 days from biometrics to interview :-(

It doesn't matter now but for others reading, you do NOT need to know when you are going to travel. I had absolutely no plans to travel - no date is required. I applied just in case to not end up in your situation.

Thank you. That's helpful. Not sure why I convinced myself I needed to know travel dates.

Probably because the form asks for it :)

But when filing with AOS (or with pending AOS) your AOS is your only explanation for needing/wanting the AP which comes as an ead/ap combo card in that case.

Ah. Thanks! I knew I'd read it somewhere! I understand that if I send a copy of my NOA for my AOS with the application that will suffice.

I thought the same thing (that once it switched to interview is being scheduled you will definitely get an interview) but someone here on VJ corrected me before that it can stilll end up getting waived. Supposedly has happened to some people before.

I was hoping my interview would be waived, even when my status changed to ready to be scheduled for interview, because I read someone somewhere telling that would be possible.

I researched extensively for threads on this subject, to read the successful outcomes, but found none.

I ended up having the interview.

Once it says ready to schedule, that means it is tramsferred to your local field office. They can give an interview waiver but that usually takes longer than having the interview itself. Once it says interview is scheduled there will be an interview of course.

Interview waivers from the field office (as opposed to the NBC) will receive an interview waiver letter. If approved at the NBC you are simply approved.
